A Nepali is in prison possibly for crimes he did not commit. There needs to be another investigation into it.

Nas brother, I have no problem supporting  a retrial as well. Other than the evidence discussed, I don't know what other evidence were needed. I again retierate my point, if Advocate for Ajay group wants us to sign their petition, release the transcript of the conversation between Ajay and the victim-unaltered. We will then decide for ourselves and sign or not-sign the petition. If you want to petition for a retrial I am up for it.

Nas: After listening to the link that your provided in completion, I too think that the accuser here is certainly not a innocent damsel in distress. She seems like pretty chaalu type and yes, of course full of lies. I would not disagree that she is a bit of horny ho as well... But this still does not make Mr. Rapist here a saint that some people seem to portray him as...

These days anything is possible. We, Nepali people, need to hear the tape, not the translated version, to join the cause before we sign your petition. If you're so sure of his innocence, stop wasting time here and writing things on "what you think happened". Make us believe with facts, not with emotions. We want to help.

My feeling is similar to that of Nas.

I am not one of the signatories. It still make me sick to think that a man would sleep with someone he called his daughter.

But I think the rednecks put him in jail for no reason. There is no evidence to show that he committed the crime (even though I think he probably did). And even if he did, 360 years is , well, WTF? 10 years is enough for such alleged crimes. It is not as if the girl was molested, beaten, killed or anything. Punishment has to be commensurate with the crime. How long are they gonna keep child molester priests then ? 

My hunch is that the rednecks didn't like the fact that this Indian-looking guy was married to a white girl in the first place. They were like gotcha..let us put this darn farnar in jail and let him rot there. In south, they used to burn the black men just for looking at white girls.

And now that the man is in jail for 360+ years, the onus is upon the jerks who sent him to jail to rot to prove that he raped the girls. Not to those who asked fair trials.

Kiddo, it was Woody Allen , not Woody Harrelson.

you guys are acting like your signature will give him another trial. it does not even matter what you guys think. we all are so scared here that we will put up with anything that happens to us. when have Nepali people stood together to support another Nepali? NEVER. maybe few of his close friends and families tried to protest but Nepali in overall will never come together and ask for a fair trail. you all are so busy showing your intelligence in a public forum, but deep down even you know that you can't make a difference so stop acting like the whole world is obligated to show your proofs to gain your support. honestly, i would think that the jury in that county would relate more to a local homeless drunk than another brown skin Nepali.

Guys, just a very general question, a man who brought a child as father and later he found she was horny. Sorry guys, all of the daughters will be horny at that age, it is father's duty to protect them not to molest them. That girl didn't have any idea what his father is doing and after doing there is no any relationship exist. So, I don't know how many years he should be punished but any one did that crime can not be protected. Dev realized that his daughter was horny when she was alone in home. That is not unusual, fathers protect daughter for that day she will be horny and she will leave home with someone else. That is a part of life not only Nepal, in every civilization. If we think Dev is right, there will be such crime at every home and every father can see their daughter horny, sorry guys again.

To me this discussion is a moot point until I see the transcript of the taped conversation where the famous sentence was made.


 


I don’t know why it becomes a big issue making a judgement on Nepalis overall. So we don’t support a guy just because we don’t have enough information concludes that all Nepalis don’t support their own countryman. First of all let me remind you that the prosecution-the victim is also a Nepali. If you sign the petition I will accuse you that you aren’t supporting another powerless Nepali.


 


Think about it for a while, we have only heard the argument from defense side. Let’s say the girl comes tomorrow and lays out her story to you and you actually feel that she was indeed molested/raped against her will, how would you feel signing the petition? Let’s say she claims that yes she was molested against her will but she kept quiet because she was threatened of deportation and at that time she didn’t know her rights. Her stories changed because she just couldn’t recall all the details to the dot. Why would she phone and ask to have the conversation taped if she was trying to frame him? She is accused of filing the rape case when the she had issues with her visa, but how did the issues came up all of a sudden? She filed the case and withdrew and filed again after she was stopped from coming. She also didn’t report the rape case earlier. But haven’t we heard of countless domestic abuses that have gone years without being reported? Her backflipping on the accusation could have various justifications, such as she wanted to let it go considering the amount of agony it would cause her but later she had to press charges again because she was stopped by the defense to come to US.


 


I am not trying to build a case for the prosecution. All I am saying is we are hearing from one side and making the judgement to sign the petition. Let’s hear the actual gist of the story which revolves around the tape conversation. You might not give so much importance to your signature but I for one don’t want to be a part of anything that has a potential of supporting a merciless criminal. Let’s get the story straight first.

Ok if you believe that saying "adopting 15 yr old is different than adopting an infant" has sick connotations then I will let your sick mind come up with any kind of your own personal conclusions. After all a man only sees what his inner mind wants to see and is familiar with.

I'm not even sure what you are arguing with me about here! Let's move on and focus on the main issue here. This posting is about a Nepali man who may be serving more time than he deserves.

Even a murderer doesn't get 300 years in prison and many things in this case points to the possibility that the girl involved may be concocting stories and is not reliable. Also, the behavior of the district attorney and the judge seems to be intent on indicting this man instead of giving a fair trial.

That is why we need to discuss what can be done so that there is a possibility of a re-trial.

Newlynew please leave your personal grandeur aside because we all know you are the smartest person and you know everything you are talking about and you don't need to insult others to prove your point. Let's focus on the main issue without trying to prove you are right and others are wrong. I think it's clear that you wanted to hang him initially or give him 10,000 years in prison and now after reviewing the case more, you sort of agree that a retrial is not a bad idea.

Correct me if I'm wrong here.

I have been following this discussion and wanted to chime in few things.

In a society there are different types of people. That is why there are different political parties. Pro life, or pro choice. In the same way, there are people who are more lenient and those who are not. The poster here grgdai seems to be lenient and forgiving and focused on the excessive punishment, while newlynew is focussed on the severity of the crime itself.

Maybe they can sort out their differences in email so that this interesting topic does not get spoiled by personal egos.

We are commenting here as we heard the story in past and present and depending upon our mental status as well how we process our thoughts. 

We do not know the exact story and their family dynamic and the real inside story but we heard the superficial story as it broke it and we became the juror in favor to convict and against not seeing enough evidence to convict.

 The verdict was solely based on the tape conversation between the girl and Ajaya( she may be abused by him or may be because of her behavior she was taken to Nepal and in anger she was trying to take the revenge or it might be mix of both,  we  do not know the truth ).
Lets be indifferent, as per NAS's comments on other thread, she had been not telling the truth  and  certain evidence was lied and does not favor her? If that is the case she may had fabricated? 

The wrong doer must be punished but the question is who is right/innocent and who is in guilt/wrong, we do not know.
And Please, do not comment absurd like she is not her own daughter and had consensual sex, even she lied her aged during the adoption  but still she is her adopted-daughter, the relation must be maintained and must follow the law and rules otherwise punishable. Guilt person must be punished.

The idea of adopting a child (anyone under 18) with the prime motive of tax advantage and the motive of being adopted for immigration benefits got completely overwhelmed when indomitable gush of testosterone decided to take over. And as they say "once you pop, you can't stop", the occurrences continued either mutually or forcibly each time.
Had the child carried the same DNA as the accused and had the accused seen the accuser grow up right from a baby into a budding woman, a certain level of natural  parental bond would have been formed.  (Has anyone of you run across any true story in which a brother and a sister had been separated for most of their childhood and reunited during youth only to form a incestuous relationship? My understanding is early childhood is probably the best time to create bonds with your family members - may be even for adoptive ones. Do not quote me on that; I used the keywords like "probably" and "may be" and I am not a psychologist by profession.) 
Biologically speaking, in this Ajay Dev case, the sexual relationship is not even incest. It appears that Ajay Dev is guilty but more than three hundred years of sentence is a joke to the firm stance of the US Government when it comes to human rights at places as far as the other side of the globe while it lags so much behind at its own turf. Some racist jurors could not stand a brown man married to an all-white American woman, perhaps. Jurors probably thought they can easily get away with such a harsh sentence. A rape and murder convict would probably get a lot less harsh sentence.

Someone above wrote that the whole adoption thing might have been a facade to bring the girl to the US. And that was the context in which I made the comment because the adoption seems fake because why would you adopt someone when they are 15 yr old instead of adopting someone as an infant because in my opinion it's not the same thing.

And painting him as a saint? You are surely making things up here. I thing he deserves a re-trial. If saying that is same as painting him as a saint then I have to admit you are a creative genius.

What I can infer from the discussion above is the obvious - We, nepali guys, are  misogynists: consciously or sub-consciously. We are ready to give benefit of the doubt to an male ADULT merely citing his uncontrollable hormones. However, the fault lies in the 15 year old, who planned deliberately all these years to reap the benefit of a US citizen. Hence, he's the victim and she's the culprit. Just like in all the aspects of our society, its always HER fault. Bravo!
