A Nepali is in prison possibly for crimes he did not commit. There needs to be another investigation into it.

I have seen many postings on this and have read few articles already. What I have concluded thus far is that it appears that at the most Ajay might have had consensual sex with the girl, but not rape. I am not sure at what age this happened and if this did happen he should confess, this might make the case easier and his sentence might be significantly reduced. If the sex never happened then why did this conversation take place in the tapped phone:


 


Juror Blog: In the pretext call, Ajay admitted to having sex with the victim after she was 18. The exact quote is "You f$#*ed me after age 18, that means you gave con


sent". The entire defense was that no sexual relationship occurred and that it was a story made up by the victim. With his admission, that defense was completely disregarded.


 


The defense’s argument is that what was said is lost in argument. Another blogger even says that a nepali language expert brought in the court concluded that the sentence doesn’t reflect admittance of guilt.


 


I can only make my final conclusion if I hear actual text of the conversation, specially the part quoted above. I don’t want an innocent man to be jailed, but although her case looks really weak to me- I also don’t want a victim not to get her justice if that really happened. I would sign the petition if somebody can elaborate on the quoted conversation, which was also the decisive proof for the juries.

visitors, not so much for the visitors, but for the food in the visitor

couldn't make myself eat much of the vending machine food offered.  It
was tasteless, processed and way below school cafeteria fare--nothing
that people on the outside would look forward to eating.  I asked Ajay
about what he eats on a regular basis.  He told us that he eats slop
every day.  Twice a month he gets BBQ chicken ,which is the big
excitement. 


2.  I asked Ajay about his cell.  I wanted to know if could move
around and get exercise.  He has just enough room between his bed and
the wall to stand sideways (just shoulder length).  He could jump up and
down for exercise, but not much else.  He tries to do push up and sit
ups in his bed. Also there is no privacy for bathroom issues either.  He
and his roomate have hung a sheet up between the bed and the toilet so
they can have some privacy.


3.  The yard they get for exercise is only dirt and no shade. The toilet there is completely open to the public.

4.  On every third day Ajay is in lockdown (in cell for the full 24 hours) because of budget cuts.  The guards have to take furloughs for budget reasons so the prisoners just get left in their cells.


4.  Before Ajay can come see us he is completely stripped down and then has to be stripped again when he leaves.

5. One thing that really bothered me was that children the same age
as Ajay's kids were playing within in 5 feet of where Ajay was sitting
while visiting us.  There are guards everywhere watching everything that
is happening, yet Ajay cannot see his children.  It made no sense to me
that the warden would not grant Ajay's request to see his children. 
There was no way the warden could think that Ajay's children would be at
risk given the set up of the room.


 

With all of this Ajay seems to be coping.  He says that the visits,
the letters, and his family and friends are keeping him going.  He
realizes that he is unique in this prison.  He gets more support than
anyone else he knows.  We spent most of our visits talking about the
case.  What kept coming up was the absolute ridiculousness of this case,
and how incredible it is that the jury convicted Ajay.  When we analyze
the trial, it is so very obvious that Ajay is innocent and that the
accuser is lying. 


 

I walked away madder than ever.  How can Ajay be in jail, not seeing his children, and being treated like dirt.  Especially because

1.  Ajay helped the accuser to come to this country for a better
education and better life.  When Ajay gave the accuser a hard time for
throwing away her education and being promiscousness with boys, the
accuser tried to cover up her shortcomings by retaliating against Ajay. 
Five months later the accuser drops the charges, but then when the
accuser lost her ability to come back to the US (because she was
criminally charged for passport fraud in Nepal), she started up her allegations against Ajay again in order to get into this country.  The accuser's motives are transparent.


 

2.  The prosecutor and detective did no investigation into the
accuser's claims and just pushed this case forward.  Then once the
accuser's testimony starts to fall apart, the prosecutor claims that she
just can't remember things. Finally, the prosecutor and investigator
misrepresent evidence in order to convince the jury and the judge allows
all this to happen. 


 

Sorry to go on for so long, but I think it is important for you to know what Ajay is facing.

 

 

Below are two articles on the Vanguard that are worth reading and
commenting (blogging) on.  We know grant funding is one of the reasons
that Ajay's case was pushed forward without investigation. Here's an
article that shows that the DA is willing to offer criminals no jail
time if they admit to gang membership.  The DA is showing that his
priority is fulfilling quotas for grant criteria more than justice.

Finally, we are only 4 signatures short of our 350 goal. 
Hopefully, we can get these four signatures plus another 25.  Our goal
for next week is 375. We need to have politicians and people understand
that we need an investigation into Ajay's case.  The link is below.

My question is why should a repeated rapist of own daughter get a sentence less than 500 years? Some of us are not satisfied with the lenient sentence handed out to this evil man.

Simple thing is Ajay thought he was in Nepal and he didn't do any thing wrong. He forget he was in USA, and there might be a punishment with 300 years in prison. Ya, many times we had similar kind of mentality and we were joking with these laws and systems, the result is Ajay.

Ajay, it is not Nepal but our mentality is Nepali. So, try to change the mentality, it is not only lessen learn for him but for the entire Nepali community. Be aware, we are in the system where every one should be responsible, if you are not responsible, every one can be likely to be Ajay. Upendra Mahato's dad similar type of crime but he is free in Nepal. If he were here, he will face probably 30 years in prison.

This case is not as easy as it seems. Being a Nepali citizen my heartfelt sympathy goes to Ajay and i do feel bad for him too. But what on earth makes him so horny that he started having sex with her adopted daughter. Even if it happens after she was 18, but how can one do sex with his daughter. How can such feelings comes in a man when he regard as a daughter... 
I do agree that sex is a big evil thing inside every other man and yes i do agree with what NAS said, "They say when a man and a woman is alone in the room, there are actually three persons in that room. One being the devil." We have heard so many other incidents where brother having sex with his sister, brother in law having sex with her sister in law but those things happens in the developing country like ours and are done by the uneducated people but being an educated people and esp staying here in U.S. how can a man like Ajay thing of doing that. 
OK, let's forget that fact that Ajay also has a devil inside him and have sex with the girl but why the hell he threatened that girl when he was in Nepal. Just because he was afraid now that she will reveal the truth in front of his family.. May be now he already had a enough pleasure with her body and now he don't want her to come back to U.S. so that his family will never be aware about the issue... 
I am not trying to be a d**k here and accuse Ajay for everything. Yes in some extent it was girl's fault too. First i don't know whether the sex was done in mutual understanding or not but if it was that the story is different and may be she was trying to be rich but if it was not done in mutual understanding and he raped her than why the hell she didn't inform the authority or his family members.. According to what i heard it says that they had sex many times. So why on earth she kept quite and didn't inform to anybody. Oh well may be she was also having please huh....
Well i don't know what's the real story is but i am not going to sign the petition just being a Nepali because rules are made for everybody. I didn't like the view of some of the sajhaities here who are not happy with the 300 years imprisonment. 300 years life imprisonment means lifetime imprisonment. So that means Ajay has to live in prison for his lifetime.. If that's the punishment for raping a child than he deserves to be in the prison. Though i feel bad for his little kids and his wife but it's all because of him and if he has done something wrong, Yes he need the punishment....
If somebody can come up with some more specific points to prove Ajay didn't do that and he doesn't deserve the punishmement, than i will go ahead and sign the petition. Thanks.

In the states, President Clinton could screw a girl of tender age (in terms of their age difference), lie about it and avoid jail.

If you are Woody Allen, you could screw your daughter, marry her and still be out of jail.

 If you have money and power, you could do pretty much everything here too. 

Ajay chose to live in this country. I think he came here when he was 4 or so. He married a redneck somewhere in central california, I have heard. He lived with the rednecks all this life (or until 40). Now he gets redneck justice. His mistake is to be here, be as indiscriminate as Woody Allen or Clinton, but not have enough money to buy justice.

I hate the way American justice system works, but hey,  if you have seen the Jack Nicholson movie, Chinatown, (Which I suggest you all to watch for a fitting context), Jack would say, let's forget this all, this is Chinatown!

Pire, you are right, if you have money here, you can do pretty much here. Examples you have given in few in hands, ten of thousands rich people are in jail in USA, you forget another part of story. Please don't give some of the funky example here, you can do a lot with money here, but other tens of thousands who had money are in justice in this country.

Please get these information in US justice system, I don't have much time, but I think you like Mr. Ajay and try to follow his path. I don't have any problem.

well,if this is how you react, it only shows how stupid you are.
[I don't think time is an issue with you. It is just that you can't justify what you just said. Which department tells you the wealth of convict? Which database? You just blurted out something that you can't substantiate.]

You make a statement, and you can't prove it. When someone asks you to furnish proof, you accuse him of having a particular preference.

Let me tell you one thing, most of the people who demand harsh punishment to a criminal tend to be criminal themselves. They demand harsh punishment because their soul is dark, and they try to hide their dark soul by pretending. You will never find Gandhi or Mandela asking for harsh punishment; you find them asking for forgiveness and leniency.

Man to talk with you much harder than Ajay's Case, ya I was saying before that anyone who is thinking from Nepali mentality, just don't think in that way. You might be Ajay, I might be, or you might be. Yes definitely I am not the guy who can give database, if you don't like Justice system here, go back Nepal and get a good justice system. Non of the system are 100% , neither ours or USA, but I believe if they don't have a good justice system, you and me might not be here too, we will be fighting like Pahades, Madhise, poor, rich, while, black, in our own country.

So, sorry Pire, I don't have much time flirting in Sajha but what I was trying to say, either this system is good or bad, before doing any crime or any thing which is not allowed by system, don't mess up with that, I might had dark soul but because of this system, many times I don't do any thing which I might be doing in Nepal.

[And yes, I am still a Nepali. I pay tax to this government, and I am using my rights when I stay here.This is an era of globalization, and there are Americans working in Kathmandu  and other cities around the world too, so it is not a crime for me to stay here. I just avoid the trouble.]

Whether he is convicted or innocent. He should get fair treatment in the jail. He should be allowed to meet his children.
