 How easy is it to regain Nepalese citizenship

I acquired US citizenship but now I want to go back to Nepal for Good. I want to give up US passport and reapply for Nepalese citizenship? How easy is it to do this in legal way? Thanks

You should ask Rabi Lamichhane. He was able to give up US citizenship and become home minister

@Am043198... As far as I know....When you give up your US Citizenship, you automatically gain your Nepalese Citizenship status. I do not think you will have to re-apply for Nepalese Citizenship.

To give up your US Citizenship, you will have to go Kathmandu and contact US Consulate Officer through US Embassy. They will set up an appointment and you will have to pay the application fee, sign the necessary documents and you are free. I wish you all the best!

My understanding is you have to take proof of giving up Foreign citizenship and apply at your district office with previous nepalese citizenship or NRN card.

Wait for Supreme Court decision on Rabi Sharan Lamichhane. If he is found innocent, then you will have less work

Well. SC verdict on Rabi Lamichhane is out. He is considered to be not Nepalese anymore. SC does mentioned that in constitution there is provision to reapply for Nepalese citizenship after you relinquish your Foreign citizenship.

Technically it’s pretty easy, if you do it in right order like below, however not sure about practical aspect of things . Nepalese government body are almost useless hence it might end up taking months or even years to complete each steps.

1. Make sure you surrender Nepali citizenship and password through Nepalese citizenship and passport through embassy in DC while you still have US citizenship and passport . Make sure these are documented and you get some kind of confirmation of your Nepali citizenship denouncing.

2. Go to nepal and start process of surrendering US citizenship and passport, this is kind of straightforward through US embassy.

3. Once you have confirmation from US embassy, start process of re-instating Nepali citizenship through home ministry/cdo office .

Seems like you will be stateless fro the time you denounce US citizenship and nepal re-instates your old Nepali citizenship. But from practical prospective , not sure how streamlined process is this.

Oh no chicagoan...lol!!

Rabi Lamichhane (and Trump) are the last people one should follow if you want to avoid कानुनी झमेला and successfully accomplish कानुनी पक्रिया.

Now legal experts are telling Nepali news media that they had advised Rabi Lamichhane to go though proper legal process before all of this fiasco happened.

He did not listen to them at all and did whatever the hell he wanted in addition to announcing all of his extra-legal adventures on media just like Trump used to live-tweet about his inappropriate actions on Twitter.

Don't give up US citizenship yet. You are going to miss out social security benefits etc. But from Feb 1 , you can get NRN card online if you want to stay in Nepal. Check the link below. Also, new Nepali president can pass the dual citizenship law for non- saarc countries. This law was almost passed last time. NRN folks need to pressure our government. You can always renounce your US citizenship.

Renouncing US citizenship is such a huge deal since you won't have any status in the usa. It's such a cruel thing for Nepal to make us do. Most of us have spent a significant time , energy and effort and have families and other social -economical ties to the US. I really hope Nepali people would make the dual citizenship possible asap. It will only bring investments and good things to Nepal.

Thanks all for your advice. One of the problem, I am having is how to have property/ inheritance in my name. I am sure, this is an issuee for lot of people.

I talked to a lawyer over the phone. I advise u do the same. They take payment over esewa or bank transfer.what i undestand is, if u already have the property in ur name then u can keep it. U can also buy 2 topani in ktm etc as listed in nrn regulatuon with ur nrna card. If yiu have more than that then from what i heard u r given a one day lal purja to bring it to ur name then ull have to sell it or give it to someone else with Nepali ctzp.

Dual Citizenship would be help a lot of people like us, no wonder, but not quite sure if that will happen that easily. Like many other people here, (@Am041398), the property inheritance has also bugged me for a while, especially when Maobadis at one time were all worked up to seize the properties owned by people who have taken up foreign citizenship. With now Prachanda back again in power, it does not look that hopeful either...Well.
I have also some similar case, not that I am that greedy but because my parents spent their hard earned money to get together some real state and house in Nepal, now with everybody abroad, I do not know how the whole things are going to turn out. Nobody in my family is ever going to go in politics but we cannot give up the properties away either just because everybody has become foreigners.
Rabi Lamichane's case has really made my family worry about what next now? I along with a lot of other people here in US cannot give up the American citizenship because of blood, toil, sweat, tears that each one us has individually expended on their behalf and then the "constitution" of Nepal treats us like we are outsiders by birth, because we take up a different citizenship.

Bennedict, why cant u keep the property as a nrn using a NRN card? The restriction on the size of land u can purchase is only for the property you are going to buy. It seems like there is no limit on inheritence. Of course, like everythibg its kept vague in the books of law so they can always explain it to their wish and screw the public.

Atiranjeet, the limitation is on how much u can buy , not how much u can inherit. it says the limitation doesnt apply if the property was alreqdy acquired while being a Nepali ctz. Reding between the lines it doesnt say how much u can inherit. From my conversation with a Nepali lawyer u will be given a lalpurja for a day to sell it or hand it off .The law is not clear tho :(. Rabi kinda ruined it for all of us. Its gonna be tough for us now.

So, if I understand correct, there is no limit on inheritance. Property acquired while you were Nepalese citizen is fine. To acquire inheritance property need to be transferred from mother/ Father name to my name. If I have NRN card and not Citizenship card, will it be possible for the Property to be transferred officially in my name. Has anyone had any experience?

If you get NRN you’ll be more ruined. Nothing is clear in their constitution and they’re looking for ways to Fk people who have taken citizenship from another county.

There was one lawyer on TV that was saying it’s tough for inheritance cuz it’s not clear and they can spin it however they want to. Ravi’s case has destroyed lot of things for us.

If anyone complains to the authority that you’ve a US citizen it’ll be tough for you to do any transaction with the inherited property.

You r right racheeta.Ravi single handedly ruined it for all of us living abroad. On my conversatuon with a Nepali lawyer a mont ago he said we can inherit but cant pass it under our name so we r given laal purja for 1 day to transfer or sell the inheritence. This was before the verdict from the suprime court tho.
This is going to hurt Nepal so bad in a long run. NEPAL is not only ran by the remittance from qatar , Malaysia etc but a significant portion of the remittance comes from the US,aus,UK , Eupore etc as well. If there is no long term security in the county for tgis category of people ,no one is going to send money to buy land , build a house or do business. ALL people living abroad will be only thinking how to sell the property and bring their property to where they live permanently now.
It's very sad that other countries r trying to send their people to other countries and bring back skills and resources,Nepal is acting just the opposite.
