The basic notion on divorce in Nepal through consent is that a petition may be filed if the spouses have been separately living for last 3 years. Either of them may apply for divorce. The choice to just ask for divorce or a divorce along with property rests on the petitioner alone. If one of the spouse is abroad, they can file a divorce with a power of attorney assigned to their lawyer in Nepal. If both agree, the divorce settlement does not take time.
