H1-B & OPT : Things I Know

(Posted by Loverboye on a separate thread) Hi Friends, My opt got over on May 20. I had applied for h1b on last april. I joined master's to bridge gap until oct 1. I hadn't sent my new i20 for master's when i applied for h1b coz' i was in opt that time. I got approval notice on June with change in status from Oct 1. But today, Oct 1, when i went to my international student office, my SEVIS doesn't show the change in status. I am wondering when will my sevis system shows change in status. Is is usual? I am wondering whether I am in F1 or H1b right now because my SEVIS doesn't reflect change in status. please advise. you suggest will a great help for me. - Loverboye Loverboye, Your's seems to be a very unusual case as COS is rarely approved when there is a gap between OPT and H1 start date. But in your case, it seems that they did approve COS (may be by mistake) and issued your new I-94. But whatever the case, if they did, your status should be H1 starting Oct 1. SEVIS on the other hand, is just a system to keep track of international students and scholars (F1, J1, M1 only) and has nothing to do with H1 or other visa holders. It doesn't reflect the change of status to other visa categories either. Furthermore, it has to be activated or deactivated by a school official and doesn't just change by itself. From Oct 1, your record in SEVIS should be considered terminated as you are already on H1 and no longer a student. Once you mention about your COS to H1, your school should deactivate your SEVIS records immediately. I don't know why your school didn't tell you that they'll now deactivate your SEVIS records. May be you should talk to your international advisor once again.
