Hay friends one of my friend is on big dilemmas right now. He had some credit card issue from past couple years, which are unpaid balance. Today he recived a letter from some law firm on behalf of capital one. They are saying that if he didn't call that law firm within 10 days and arrange payments. That law firm will going to file a law suits again my friends. Is that possible ? Can they do like that ? If answer is yes. What are the best option for him. Please help him out with some of your valuable suggestion.

 Ask him to call capital one to see if they still have the account or they sold the account to the collectors. If the account has already been sold to the collectors, They act like a middle men and you can often settle with them for lot less.

Yes they can and will. Do not panic you can make arrangements to pay with the lawyer.

They gave you 10 days, you can suffer those lawyers for a year..and you don't have to pay a dime as well..

Dont answer let them file a lawsuit...after 10 days they will take another 2 weeks to prepare and to file case at the court.( if they are really serious about it) ..once they file  at the court..the court date will be after 2 months, that is 60 days....the total days you gain 74 days...right..

Then again,  go to the court, ask the Clerk, show your case no..and request them that  you want to see the Case Jacket ( its the folder the court put all the documents)..

Thanks Maxpyane for your respond. @ Sexy In Sari please post the detail for the free legal advise so that we can talk with them. If they filed a law suits again my friend what will happen to him ? As he on F1 status. He had lots of family problem before so he cannot make a payments on time. I am not sure but I believe he have to pay around 10,000 to few banks. I don't know how can he arranged money for that. Is it gonna be best option for him to talk with some bankruptcy people and to file bankruptcy for 10000. He was in this boat from 2009 and it's been 3 years.
