I was wondering if you guys have any suggestions about Green Card Processing.

How long does it really take for Green Card Processing? (in a typical setting)

I have been working for a company for about a year now. I had my H1 since 1st year. so i have 2 yrs of H1 remaining. (I can have 3 more yrs after that :) )
I am currently working with my employer about getting my GC processing started.
However, I have been hearing rumors about back log of GC.. GC taking longer time.. etc etc..

So any thoughts..

It's depend upon which category you fall in. EB1,EB2 or, EB3. What is your highest level of education.

I have finished Undergad.

I plan to enroll in masters program but that will be after 2 yrs..

Bond, how many years of work-experience you have? If you have more than 5 years, then you may be eligible for EB2. If you file under EB2, you will get GC in 1 year. If under EB3 otherwise, it may take about 4 years. (based upon the current situation).

but i heard some people were able to get GC within 6-7 months not even a year. is there a seperate way. what if i have associate degree and start job and applied for GC. how long it gonna takes.

To get a GC in 6-7 mths you need to be a ROCK Star!

You can get GC in 6-7 months if you can use approved labor. For this you have to work in Indian company. They will charge you about 5 thousand only for labor.

They know all sorts of fraud and short cuts.

I am really surprised to hear that one can get GC in 6-7 months. If thats possible then its really a magic and I would definitely like to know the detail process. I have been waiting for just my labor for last 5 months using PERM. My case is randomly selected for Audit else PERM should be pretty quick within a month.
And the current priority date for GC under EB3 is 01MAR02 according to current visa bulletin.

For those who are not familiar with priority date: Priority date is date when you start your green card process starting with filing of labor certification. Technically this means for someone filing under EB3, to file final green card they have to wait for this date. So, right now only those who started their labor certification by 01MAR02 can file actual final green card (I485).

Note: If you change your job before filing I485 then you have to redo both labor certification and I140.

I heard, some universities ban on use of private lawyer to file permanent residence status. In that case, university itself will process after s/he works in it under H1B for three years. If the person already has PhD and four to five years of postdoctoral work experiences, how long it might take him/her to get a permanent resident status? In such a case with particular university, should he have to wait for three years under H1B category? Any idea?

I think many who are planning work in the US as postdoc/Research Associates will be benefitted by your information.

I know a friend who got:
PERM approved in 1 week
I-140 approved in one month
EAD/AP in 2 months
AOS in 5 months

I-140/EAD/AP/AOS were filed in parallel. So it took her just a little more than 5 months. Of course, the advertising process for PERM took a little more than 2 months.

So all together about 8 months.

what is a PERM.. EB2.. EB3..

how would my gc process change if one changes job or starts masters in between the process?

I heard of CONCURRENTLY FILE FOR i-485/765/140 ONCE UR LC IS APPROVED. But is it possible NOW with EB3? I do have masters degree but in IT and my lawyer told me that we can not file in EB2 even though I have masters degree because its in IT field. So, I am wondering whether cuncurrent filing of i-485/765/140 is possible with EB3 because there is backlog in EB3 processing and the priority date EB3 is 01MAR02. I started my labor in Mar 06.
Any feedback will be really helpful because I am kind of stuck with this backlog. Any ideas will be highly appreciated.

Regarding your question bond_oo7, high level EB3 is the normal process of green card unless you have high qualification/experience, you can file in EB2. However there is backlog in EB3 green card processing and priority date is 01MAR02.
And if you change your job during green card process before you apply for I485 then you have to repeat whole process again. Once you apply I485, everything is yours and you can switch the job but your new employer should sponsor your further green card process.

i heard after 6 yrs of h1.. employers can still do yearly h1 renewal?
do u guys know for how long can we do yearly renewal after our 6 yrs?

Yes you can have H1 renewed beyond 6 years...

If you have filed your PERM labor certification and its pending then you can renew your H1 beyond 6 years for as long as your PERM is not decided on 1 year renewal basis.

And If you have filed your I140 and its pending then you can renew your H1 beyond 6 years for as long as your I140 is not decided on 3 year renewal basis.

I hope this information will help.

But I am still looking for some information on whether we can get GC soon in EB3 category NOW. And other thing is, is it possible to process under EB2 for Software Development job area.

Please provide me an advice:
I am going to apply for H1 via university system, so I dont fall under the cap. My question is if I change the job after my H1 through the university to the non-university emplyoer, then how would my H1 will transfer? Do I have to apply as a new H1 procedure under the cap or it will be easier than that?
Currently I am in OPT working for University.

8 months is a very short time. [ very efficient i would say] AOS alone is back logged [ i thought for more than a year ] (O:

crishna, as far as I know since you didn't get H1B through quota you need to apply for new H1B if you need to transfer your H1B to another employee.
