I came to us in F1 visa and due to some health reason could not go to school, Been out of status for 5 years. Now my husband who came as F1 maintained his status and his company is filing GC.
Our plan is to get my husbands GC and later when get Citizen then apply as dependent. coz it will cure all the previous out of status issue.
My lawyer said my information should be in I-140 under spouse. My question is that will it create any problem if he only mention my information in his I-140 and I-485 but state not applying at this time? If you have been same situation and have expertise could you please share how to handle this right.
