You are still under F-1 status till your H-1B starts on October. Hence, the day your application picked to October, your change of status will be in pending. I don't know if the lawyer can check your status via SEVIS, but the international student office certainly do.

Its up to you, whether you believe or not. But, it worked for me. School told me almost 15 days ahead my lawyer call me to inform I am selected.
