Kundale, yeah I can see that point. Basically, I am not defending the cops, I am just saying it's not as clear cut as we want it to be.

Despite all the boasting of check and balance between judiciary-legal-executive committee, I have to say that the most of the situation unfairly favors the law enforcement, i.e. the police department. Often time the burden of proof lies over the innocent who should've been treated innocent until proven guilty.
I think the advent of cell phone camera could address this inequality issue to certain extent - this is a great tool in public's arsenal. This is why many police departments want to impose a law to ban the use of cell phone camera in these cases. I am hoping for a federal mandate to allow the use of cell phone camera in public places - including in transactions where cops are involved. Until then, I am going to exercise prudence and advise my near ones to do the same.
