The constitution of the Kingdom of Nepal, 1990, says, a Commissioner or Chief Commissioner of the CIAA shall be removed from his office if ýfor reasons of incompetence, misbehavior or failure to discharge the duties of his office in good faith, the House of Representatives, by a two-thirds majority of the total number of its members, passes a resolution for his removal and the resolution is approved by His Majesty.ý But the constitution doesnýt say anything how the CIAA could be censored when there is no functioning parliament or nobody knows when a new House of Representatives will come into place. Now coming back to Koirala, analysts say instead of raising such fundamental issues the NC leader may not be helping his case by venting his anger against the Supreme Court. At a time when Maoists are running their own ýpeopleýs courtý in their strongholds, leaders like Koirala are expected to stand upright in favor of rule of law and honor institutions like the Supreme Court. World history is a witness that institutions like judiciary and media gradually lose their independence when a society starts moving towards an authoritarian rule. It is in the interests of all those who believe in democracy to help strengthen these institutions when they may be under tremendous pressure to side with extremist forces.
