A foreign lady is a guest in a hotel in Thamel. The night of her stay, she has drinks with the defendant, the hotel manager (or whatever his title is). He proposes sleeping together and she agrees. But when she finds out he has no protection (rubber), she withdraws her agreement. But the guy forces himself onto her. The guy even admits about it.
The gist of the article is not that you shouldn't force yourself onto anybody, thus raping somebody, but the writer rather suggests have a condom always otherwise you will be duped and blamed for a rape.
It is clear he doesn't think it is a rape case.
