Laure_boi, H1B visas start on October 1st of every year. They start taking the applications on April 1st and keep taking the applications until the quota is met. As of May 6th 2010, only 18,000 (regular) and 7,600 (Masters) have been issued. This means that there are A LOT of H-1B available. As long as the company is legit and the work is legit, your brother will have no problem getting the visa. Just ask the company to file for his H-1B visa as soon as possible and your brother will be able to start working on a H1 visa from October 1st. Until then, he will just have to remain in his current status (I am guessing it's F-1 {OPT})
