Filing H1-B, not getting Prevailing wage. Help

Hi, I have hired attorney to file my h1-b. My job title is database support services specialist which includes SQL server database adminstration, along with some helpdesk support, software/hardware installations etc. Attorney wants to file as 'DBA' since it counts as 'speciality occupation', so it will be good case, but I am paid about 5k lower than prevailing wage to classify as DBA.

He doesnt want to file as 'Network Admin' because it is struggling position and only high end network admins need bachlors degree, so it will be hard to file a good case.

I want to file it as DBA but salary is problem.

I dont want to negotiate 5k increase right now becuase I just started and it is recession. I brought up the topic first at HR but they were hesitant because of good benifits. Company dont have to pay prevailing wage until I start my H-1 (my EAD expires in Jan 2011), so should I tell my boss right now to increase my salary by 5k then? Please give suggestions.
