You can File WH4 Form at DOL but it might land u in trouble as u r not Legally eligible to get the Employement(provided u don't have GC,OPT,CPT,H1b,EAD,Severe Economic hardship)..So the best thing to do is threaten him that u have hired a Lawyer and he is going to report to DOL..Remember that it's not only u but he is also in the Line..He is not supposed to hire Non-Immigrant without work Authorisation and he might loose more money than u and can even Loose his GC and face deportation(if he's not a Citizen)..Play the Threatnening game BRODA..Hope it works for u..
