I am sure (coz this has happened to my fren) that if the extension is denied, they will give u certain time period to leave US and if s/he manage to leave within that period, its NOT considered illegal. (Even though s/he is already beyond the original visa time period in the I-94).  

But, I believe there no fixed time frame like "1month" or so to leave if extension denied. Its their judgement.

Regarding whether need to reapply again in US embassy in Nepal again to come next time, I am not sure. (coz my fren whom I mentioned above had single entry 3 months visa from Nepal so obviously he had to reapply next time.) Anyone else knows about this?
