H-1B gap--tricky situation

Respecting the invaluable suggestions that sajha members have given to me in the past, I thought its better to post my confusion here (though I guess theres no good solution), hope you guys can help.

The situation is like this: I graduated this Feb and applied for H-1. Luckily I got selected and my case is currently pending with the USCIS. In the meantime I joined another college in Feb and took out another CPT (not OPT) which is valid till Jan 2009 i.e. next year. Now, under the interim rule published by USCIS recently I wanted to change to H-1B status as soon as possible to avoid keeping on paying for college and going to class   but my lawyer said that I'm not eligible under this rule as it is only for guys whose OPT is expiring before Oct.

Now, is there anything I can do to avoid going to college till this Oct but have a valid work authorization at the same time? I've already taken 6 credits this semester at this college but I don't think this college will allow me to skip the summer classes.

Any insights and suggestions will be highly appreciated.
