Ok, I am definitely not a lawyer, but I do know that if our current company can't get you job and keep you on bench for a month then that is illegal under US law. So, you can definitely transfer your H1-B to another company. Check with some Lawyer forum and consult with good lawyer. It's about your future, do not gamble.
