VincentBodega In somewhat similar case Michael John Simmons vs State of Florida Supreme Court of Florida upheld the Florida State Laws and the Supreme Court justices unanimously upheld Florida laws that make it a crime to use online services to lure or entice a child and transmit material harmful to a minor. Michael John Simmons appealed his 2 concurrent 5-year term probition in Florida Court of Appeals on the grounds that statutes that make it a crime to use online services to lure or entice a child and transmit material harmful to a minor were unconstitutional and violated his 1st and 14th Amendment rights. Florida Court of Appeals threw out his appeal. When defeated, Michael John Simmons took his case to Supreme Court of Florida where he got wacked again. ---------------------------------------------------------------------------------------------------- Michael John Simmons was charged with trying to pick up a "13-year-old girl" named Sandi in an Internet chat room and arranging to have sex in a motel room. The part of "Sandi," of course, was played by the Columbia County Sheriff's Office, which was lying in wait at the Lake City, Fla., motel when a hopeful Simmons showed up in July 2002. Simmons, who had been living in Virginia, eventually pleaded no contest to the "harmful to minors" charge and other charges, but he reserved his right to renew his First Amendment arguments on appeal which he eventually lost both in Florida Court of Appeal and Supreme Court of Florida.
