I do not know who wrote this article but these lines are the solutions that have been aptly put forth "If the government makes the third party insurance mandatory, no driver would need to even think of taking the risk of killing a person. Third party insurance bears the cost of the losses of the victim party -- be it another vehicle or an individual. The premium for the third party insurance is also very nominal. If the government takes the decision promptly, the disturbing issue of killing accident victims by the drivers would end forever." I just wish to elucidate thaem. As I see in India, it is the best approach to tackle this problem. Some points government should consider is 1. Pass an amendment act where any civil liability will be borne by insurance company. 2. For that, all the Motors (Tempo, Truck, Auto, Bus, MiniBus everything) must have cumpolsory third party insurance. Give two months to take such insurance policy for the existing vehicles owners. and any new motors that are going to ply must show such insurance policy before taking road permit from ministry of Transportation. 3. Make 50,ooo Rs. as a third party ex gratia compensation for death and upto 1, oo, 000 Rs. for medical treatment. 1 lakh is maximim limit and insurance company will pay as bills provided by patients. 4. make vehicle owners' civil and criminal liability in case he does not take third party insurance as mandated by the law. Make owner liable not the driver. In case, owner and driver are the same, he will be personally liable for civil and criminal matters in case he fails to take Third Party Insurance. 5. In spite of such insurance, if motor driver kills the person intentionally, take the cognizance of such case by ward or area inspector and file FIrst Information Report suo moto and start investigation on the crmies culpable homicide amounting Murder. I hope these measures, if implemented, will work.
