We do all type of cases everyday and if the passport or I-94s are lost, we just state it was lost. In the mean time u can apply for passport as said to adjust ur status. Majority of the muslims were caught when they went for NSEERS. IN the above case, similiar thing might happen. So it is better to make a case pending with the USCIS or the court before filing the complaint which will allow him to make an argument to have the application/ petition pending and can ask for certain reliefs like motion for continuance at least to have the case adjudicated. Or he can substitute his LC and adjust his status under section 245(i) which is the easiest way regardless of current status.
