Delicate, As long as you have H1B status valid and proper documents, you shouldn't have any problem to return the US. As H4, anyone can start school since the day he/she arrive in the US. I suggest you one thing. Have your spouse (H4) start as non-traditional student (taking classes without formal admission) if she's undergraduate student. That way you may avoid TOEFL.
