i think you need to get that waiver from state department even before you apply for GREEN CARD or even H1. you would need to get a letter from nepal from a SECRETARY level OFFICER validating that [ sth like that] then get the waiver. then think of visa status change and green card. i think your international advisor will guide till then as well.
