This is the response they filed for the question the judge asked last Friday. Ending Nepal’s TPS designation doesn’t by itself put anyone behind bars. It simply means those former TPS holders no longer have protection from removal and, if placed in immigration court, must show another legal reason (like asylum) to stay. Only once there’s a final removal order could they face detention under the usual rules.
