Visa Overstay Could Be a Crime, with Jail Time Up to 6 Months for First Offense.

The Visa Overstay Enforcement Act of 2023 is under review by a House committee. If Trump takes office, the bill might pass very quickly.

Under current law, overstaying a visa is a civil violation, not a crime. This means there are fines, but it doesn't result in criminal charges. However, the new bill changes this, making overstaying a visa a criminal offense. If passed, even staying one day past the allowed time could lead to criminal charges, making it much harder to get a visa in the future.
