Hey Guys,
My parents are here in Tourist visa for 6 months, after that I extended the visa and they got to stay for 1 year.
From US Embassy in NEPAL they got visa for 5 years. Now if they go back legally within a year, will they be able to come to USA right after 1 month or not?
I heard rumours that if their visa is extended for a year, they will not be able to come back for a year.....................
And they must stay in Nepal for at least 6 months to come back to USA.
Does anyone know anything inregards to this issue?
Please pass me any info regarding this..................if u know!
Thankx!

Dear friend,
Don't worry !!! Your parents can go and re-apply in Nepal. Remember don[t ever let your parents to over stay herev even 1 second. If they ever do that than chances of getting visa to come back here again is very very very very slim. Thanks.

Thankx! David,
But I think you misunderstood me.The question is not if they can apply or not? They already have visa for 5 years.
They have authorization to come to us for upto 5 years from nepal already. They donot have to go for visa again.
Since they stayed here for 1 year instead of 6 months which was stamped on their I-94 on the port of Entry to U.S, I asked INS to extend it for a year.
They have approved it and now they are with me legally.
Now they will go back within the legal time, But the question is:

Can they comeback to USA right after 1 month when they leave from usa or not?
I have heard that if your tourist visa is extended then you will have to stay in nepal for another 6 months before youare able to come back to usa.

However I donot see any clue to why they cannot come back to usa right in 1 months after they legally go back to nepal within the stated time ?
I want to know the truth...........
Please post any comments you have on this board as it will help me a lot!
Thankx again,
Sundar

Dear Sunder,
Namaste. Oh !!! now I understand your point. They still can go back home and come back in US. Yes, it used to a six month time bar once your visa been extended to come back here again. Now if you could give them a good reason why they should be here then they will allow your parents to come back otherwise they will have to stay there ( I mean in Nepal ) for six months. after that they can come back here. Good luck and if you have any doubts and questios then you can always talk to reliable lawyer who could help you out in this matter. Take care...

-David
