Hi friends do you know how long will it take for a foreign trained nurse (trained in Nepal) to get H1B or green card to practice in US after passing NCLEX RN exam? Is it same for nurses from all foreign countries or has a different quota and diffrent waiting times for different countries?
Do you know anyting about the renewal of the new green card quota for nurses?

Thanks

I do not think that foreign trained Nurses can apply for H1B. The only nurses that can apply for H1B are those trained in the US with BSN degree. Even the US trained nurses with just the Associate degree are not able to apply for H1B though they might have passed RN licensing exam.

As far as applying for GC, due to Visa Backlog, even this avenue is closed as of right now. The Democrats tried to pass a bill to recapture some unused visas for Nurses but was defeated by the Republicans in the Senate. However, it is best to consult with an attorney.

I don't know if a foreign trained nurse can apply for H1B visa or not. As far as I know minimum requirement for H1B visa application is 4 years of study in US college/university ( traditionally a batchelor degree) or 2 year degree ( associate degree) plus 2 years of experience in or outside US that requires a two year degree.

My opinion is based on the H1B bulletin published in 2005. i don't know if they have changed the law.

I am not a lawyer.

for more info visit ww.uscis.gov and www.immigrationportal.com

good luck!

Hello Late-Entry,
here is the scoop; to apply for H1B visa, you must have Bachelor's degree; from my knowledge, most Nepalese Nurses however have only Diploma or something; hence do not qualify for this. However, even if you have BSC degree, for H1B category, most likely you will not get because they seek Nurses with management experiences.

But here is another category just for Nurses called H1C, bu then the problem here is that there are only I think 600 VISA available each year, and these mostly goes for
Nurse Anesthetist or Emergency Nurses and if lucky to those graduating from US institutions.

So the last one is direct Green Card; for this purpose, you must have sponsor "i.e job ready in US." thats why most almost all foreign Nurses have to-go through some kind of employment agencies and or
immigration agencies. Its not as easy as it sounds or look. If you're already in US, then its fairly easy.

In any case, you need to have "Sponsor," without it you can not do anything - nothing. Try this link below. http://www.mwnis.com
