Hi,

I applied for asylum and haven't got date so I need to enroll in college to save my status. Here college fee even in community college is $5500. I am now confused if it's worth it to pay or I just go out of status now or maybe pay that $5500 to lawyer later if I don't get approved in interview. I really look forward to hear from you guys.

P.S. if you guys know any reliable lawyer to suggestion, can you share with me please?

Apply for TPS and ask your DSO, if they can keep your SEVIS active. Which state are you in? Find a cheaper college around.

I haven't applied for TPS as I was applying for Asylum. I'm in Vegas now and cheaper college here is $5500 and I happened to apply from here for my asylum. Very strange situation!

Also, you gonna have to have TPS approved for maintaining the status right? or you can just apply and ask to DSO?

Apply TPS and stay in TPS instead of being out of status, at the mean time you can continue with your asylum process and searching for college.

Once you apply TPS and receive your notification, it will keep your status alive.

The thing is that I"m out of time... I have to enroll in college at any cost this week if I have to save my status..lf I apply for TPS today, can I go talk to my existing college and take break of school? or does it have to be approved and everything for me to talk to my college?

You might get notification within a week which can save your status. if you cannot pay your school and need to take a break, go and talk with them and mention that you have applied for TPS. Also as F1 you can apply for financial hardship and work off campus.

Immigration Relief Measures for Nepali Nationals:
USCIS has several immigration relief measures that may be available to Nepali nationals who are affected by the magnitude 7.8 earthquake that struck Nepal on April 25, 2015.

Measures that may be available to eligible Nepali nationals upon request include:

Change or extension of nonimmigrant status for an individual currently in the United States, even if the request is filed after the authorized period of admission has expired;
A grant of re-parole;
Expedited processing of advance parole requests;
Expedited adjudication and approval, where possible, of requests for off-campus employment authorization for F-1 students experiencing severe economic hardship;
Expedited adjudication of employment authorization applications, where appropriate;
Consideration for waivers of fees associated with USCIS benefit applications, based on an inability to pay; and
Assistance replacing lost or damaged immigration or travel documents issued by USCIS, such as Permanent Resident Cards (green cards).

But then again, I am applying for asylum ..will applying for TPS won't impact that as both of them serves opposite ways..

Don't make stupid mistake that you will have to regret for your whole life. I was in your situation 10 years ago. Paying tuition as an F1 student is tough and you may have additional family responsibilities. However, if you work hard , you can make it happen. Life is not easy, you're gonna have to work hard, but that is what going to make you proud one day. Don't give up guys!

Don't waste your short and Value able life searching for your status .

I agree with meron_namm_ho dude, try not to loose your status until you have secondary option. work hard, once you loose your status it is difficult to get it back. It will cost you mentally , physically and $$$$.

mentally: you will always thinking you don't have valid status and you can't go out of country.

physically: since you don't have status, no one will hire you in good job ending under table, under paid job, hardly $15/hr. you need to work more hours to fulfill your dream.

$$$: If you try hard to maintain your status, complete your degree, at least Associate Degree. This will help you later, if you want further education.

If not, you want your status back, you have to get it by filing Assylum or marry kali/gori and spend $$$$. Anyway you will be screwed.

Until you get TPS, don't give up hope, pay that 5500 to college, if you can transfer to cheap community college, that would be grt. why you want to risk your life for 5500 and finally you are getting TPS benefit.

U can come to texas as well. Community colleges are around $12-1400/ per semester.

Do not ever go out of status. This is not 1999 or even 2005, things are tougher these days and will only get tougher. Once you are out of status your only option is marriage to a US citizen. And i doubt any nepali citizen will marry an illegal alien. Dont be short sighted, do the hard work right now and reap the benefit later.

Life gets hard after being out of status, from getting a driving licence to maybe getting a nice job one day will not be possible.Besides some states even have checkpoint where they can catch you.Don't do it until it is the last thing to do.
