 Prenup before wedding

 I am getting married in a few months. However, I want to have a prenup before I get married. I don't know if this is usual in Nepalese marriages these days and I don't know how the bride's family will react. How do you think I should bring this subject up and how is this done in Nepal?

 well, if she commits adultury, Nepali law prohibits the provision of sharing the property with her in the divorce. correct me if I am wrong.

 wow...I think we have strayed way to far from the topic here. Do you think if I make a prenup in the US and get married in the US, I can use that as a legal document in Nepal?

I think not- because of different jurisdiction. If you commit a crime in the US, would you be prosecuted in Nepal also? Probably not. But what do I know. Just guessing!

 there should be some Nepali lawyer's "kid(s)" reading this thread. May be they can find that out for you from their parents!

In the event of a divorce you can do an out of court settlement. If she pursues the court system, it takes years and years (may be 10 or more), not worth the trouble. And if she gets re-married while the case is going on then she's no longer entitled to anything.

Then tell your parents to create a Will if they don't have one or add new conditions in a Will if they have one, before you get married.  

Do write such conditions in Will even though there is a divorce she might not get that much benifit because you've limited power over the 

wealth,business and property. 

So that way, if you are in US with Green Card and she stays in Nepal after the marriage while case is processing, and if any how, she wants

to divorce, since you've limited power over the property, she has to go through your parents, sibilings, all the people who involve in the Will. 

Biggest advantage is you don't have to reveal your parents Will when you get married to other party.

beware! its important to do if YOU have assets, BUT my girl never forgave me for it. im glad i did it but she never forgot it. make sure and read it and change as ness. u must use TWO different lawyers ($$) one yours, one hers. But it can really mess up a marriage from day 1. also beware if in USA of "community property" states, which means, she gets HALF of all if you divorce!

No prenups available in Nepal. And try getting a divorce in Nepal it's very hard if your wife does not agree as divorce laws are very women friendly
Close your eyes get married and get a prenup here at least your assets here can be protected if need be

You can say this over a cup of tea. "Hera na mero euta saathi bharkhar nai bihe gareko. Usko budi ta lalchi rahicha arko sanga affair gareyra ani mero saathi lai divorce gareyra usko 50% property pani lagecha."  "Kasto zamana ayoh achel ta kaslai biswas garnu pani nahune."

Meanwhile your future wife would be shaking her head and listening intently. Then you change the subject . About a week later while having a cup of tea you can broach the topic like this.(lets assume your gf name is pepsi)  "Pepsi , i have been thinking about this for a while. I think we should go for a pre nup."  :)))

The idea of prenup is not bad in itself in today's world. But in the context of our country, I don't think it will be acceptable to any girl or her family. First of all, when you mention the prenup deal, it might be perceived that you don't have faith in the marriage. And this might make them skeptical to even give their daughter's hand to you. I'm 100% positive that you will not be able to marry a girl with this condition in Nepal. Marriage is indeed a gamble. You cannot play safe. So the best option is you should get to know the girl very well before deciding to get married to her. The most important thing for a good marriage is that the family background of the bride and groom should match. Coz this shapes their nature and thinking. You must have a good wave length with her. Hope that you find such girl and you don't have to worry about prenup. All the best.

 thanks for your concern efg, but I just don't know how well is very well. As I've mentioned already we have already been together for a year and things are going perfectly right now. I just want to make sure that I'm afloat even if our love boat sinks someday..
