We are planning to apply for the US Permanent Residency under EB2 - National Interest category. If good folks here at Sajha can recommend a good, competent, client-centric lawyer, we would be very grateful.

Also, how important is it to have the attorney who is local as opposed to the one who is across the country?

Chatmandude - OMG, you are in Australia right?? why would you ever want to leave Australia for the US ke, don't make the same dumb mistake i did ni! Compared to Australia this place sucks ke! trust me you don't want to come here if you are already in Australia ni!

NATIONAL INTEREST WAIVER PETITIONS (EB2)

With respect to physicians and scientists, the National Interest Waiver category (EB2) is divided into two subcategories.

a. The first subcategory is concerned with highly talented physicians and scientists who are seeking to obtain the U.S. Green Card based on the claim that his/her immigration is in the U.S. national interest. In this subcategory, the applicant needs to submit substantial documentation to show that his/her permanent presence in the U.S. would substantially benefit this country in the field of medicine, science, etc. The physician/scientist is requesting a waiver of the job offer requirement based on national interest (hence the name 'national interest waiver'). No U.S. job offer is necessary.

b. The second subcategory concerns physicians already in the U.S. who have accepted positions to practice medicine in underserved areas of the U.S. or for a facility operated by the Veterans Administration (VA). The basic requirements to obtain the U.S. Green Card based on this subcategory are further explained in the answer to question No. 6 below.


The National Interest Waiver category (EB2) is an excellent method of obtaining the U.S. Green Card. It is applicable to both physicians and scientists with exceptional qualification and achievements who are living outside the U.S., as well as physicians already in the U.S. who have accepted positions in the U.S. in underserved areas or at a Veterans Administration (VA) facility

As a Law student who has seen horrendous lawyers from up close, my honest advice would be to look up the American Immigration Lawyers Association (AILA) chapter in your state.

AILA is a national entity that works exclusively on immigration issues and the local hapters have a list of all attorney's who are members of AILA. The reason I recommend the webiste is because they have a vetting process before you can be listed and having an AILA listed attorney hopefully diminishes the risks involved.

If you can let me know what state you are in, I will try and see if the lawyers I work with know of folks they can refer you to.

Thanks for the tip. I did not know about AILA. I did check Amercian Bar Association's website, but it was not very helpful. I will certainly heed your suggestion.

I am not sure how important it is for the lawyer to be local so that we can contact him/her in person. Does it matter?

If it does, Illinois (Chicago area) or North Carolina (Raleigh-Durham area) are the two preferred states to have the lawyer.

Can you help, please?

Hey,

I'll try and see who I can find in those states. As far as the local vs. across the state is concerned, I think it's best going with an attorney who is locla purely becuase it makes communication with them easier. Furthermore, you have the ability to call/visit the office to monitor that the paperwork has indeed been filed on time etc.

The American Bar Association website is very helpful once you get the name of an attorney. Every bar association webiste has information on all registered attorney's so if an attorney has ever had a complaint or a disciplinary action against them, that will be reflected on their profile page on the Bar Association website.

Also, on the ABAnet.org website, I tried to check on a lawyer. I clicked on a lawyer locator link on the left and put in the said lawyer's name. But the search came blank. How do I check the lawyer's records - win/loss ratio, complaints, disciplinary action, etc?

Attached is the contact of the Attorney in Illinois who recently gave immigration seminar in my university. They seem to be pretty experienced. They were in the top 10 attorneys in Illinois in 2005 (according to Illinois Super Layers Magazine, superlayers.com, May 2005 issue). Hope this is helpful.

Hi Santosh,

I visited your employer's website. I found that there are only three professionals in Chugh Firm who handle Immigration matters and none of them are bar certified lawyers. Am I right?
