Hi all, If the employer wants to sponsor a candidate. Can they sponsor directly from J1 to GC by bypassing H1B? Lets say, 2-year home residency do not have to fulfill. I heard if someone apply GC from J1 , she is not allowed to travel back home ? How long does this process takes for example inter university changing status from J1 to GC? i was in J1 ealier and was doing online research about going from J1 to GC. It is possible. But I did not understand when you mean you are not allowed to go home back. In what circumstances? If you apply for GC when your 2 year residency is waived, it would take typical time to get GC.

Hi bbmb, Thanks for the reply. Because if I go back, they will stamp in my passport that 2-year residency is applicable while getting new stamp on passport as it has been expired by now (only DS 2019 is active). Also, I have another question. For example, if I am willing to take higher responsibility and high position than what I have now, can I still be on J1 in higher position job title with different employer. This J1 comes with specific employer, if I change employer. Thanks agian, Yurika

I hope I understand your question. It should not matter if you get visa stamped or not. If you are in J1, you are entitled to 2 year residency. But if it is waived, you can get visa stamped and come back easily to US. You will have to goo back to Nepal only when your J1 is expired and your 2 year residency is not waived. Here is the tricky part with J1 transfer. You can go from one employer to another (no matter what position) but only when your 2 year residency is not waived. Meaning, if your 2 year residency is waived, you cannot come again in J1 even with your same employer after you j1 program ends. I hope I answered your questions.

@ ma Nepali: If 212 (e) does not apply is tick marked by consular in DS 2019. I am not sure it will apply. @bbmb: Thanks Can I take another higher position or should I remain in same position? For example if I am research assistant, can I transfer university and change title to research scientist or research associate with same J1 status?
