I really have sad story to share with. I am a PR and I got married with man who is out of status on last October, 2013. I found,he is having extra marital affair consistently with all proofs but he is still lying with me.
I filled him I130 form which is already approved now. How should I move now, first divorce or calling to USCIS to cancel all the process. Since, our marriage is not even a year can I file a divorce now? I have been living in USA continuously from more than 2 years.
Please guys.. need really good suggestion as I am in horrible situation.

What does divorce got to do with your immigration status? It doesn't sound like you got your PR through this man as he is already out of status. Please clarify why you are bringing immigration issue with divorce?

As for lawyer, yes. That's the first thing I'd do. I'd call a divorce lawyer and discuss my situation even before I'd ask somebody in Sajha.

Right, that's what I got. But isn't immigration the guy's problem? Unless she wants to inflict harm on this cheater and cancel his visa application. If this is the case she is on the offensive (not saying good or bad), her post sounded like a cry for help.

just go a head and file the dovorce.His fake marriage with you was just to get his status back! Just write a letter to USCIS saying you do not want to continue with the immigration processing, and you guys are already divorced! you have to explain them how it was marriage with a good faith, but you uncover his true intentions lately! He should be out of status in no time! GL

Yes Kiddo, Immigration is not my business, but I already applied for him I130 (which is approved)and want to cancel it now. Just wanted to make sure there will be no harmful effect, if I have to do any future immigration procedure,,,, Got your point,,,, Yeah I am really in bad situation, so you can say cry for help..But I know time heals everything.. NP,Nepalifan. If you write USCIS now, you won't have any problems in the future! But, if you hide anything now then it will come and haunt you during citizenship process.You can not tell You are married when you all do not even live together! Since, you r his sponser, you can revoke his I130 anytime before He have his I 485 approved.

You should talk to immigration than idiots including me here...

If you don't have kids, you can file uncontested divorce. It will be finalized in in couple of months. Google lawyers online and talk to them.

Just spare that poor guy and move on! You will not be happier unless you completely forgive him (and forget him). After all you are also to be blamed on this since you completely failed to know him before taking such a big decision of your life. You had green card and that idiot did not have paper and you should have at least gave a thought on his ulterior motives or tried to find them. May be its a chance for another guy to make his paper and hopefully a true love for you. If you do this that guy will repent someday. It is in his blood, gene etc to use people, and inevitably, these types of people will be caught up on their own Karma. Examples: gyanendra, paras, chiranjibi wagle, govinda raj joshi, jp gupta, mao baadi khaobaadi and many others ..:)
