मेरिकामा वैध प्रवासीहरुको संख्या घटाएर आधा गर्नका लागि ट्रम्प सरकारले सिनेटमा विधेयक पेश गरेको छ । ‘रेज एक्ट’ को नाममा पेश गरिएको यो विधेयक पारित भयो भने अमेरिकामा स्थायी बसोबास गर्न चहाने नेपालीसहित ठुलो संख्याका भारतीयहरुलाई पनि झट्का लाग्नेछ ।

अहिलेको अवस्थामा रोजगार श्रेणीमा हजारौँ नेपाली र भारतीय ग्रीन कार्डको अधीरका साथ प्रतिक्षा गरिरहेका छन् । यदि यो विधेयक कानुन बन्यो भने पिआरको आशमा रहेकाहरुलाई ठुलो झट्का लाग्नेछ ।

विधेक पास भएपछि ग्रीन कार्ड हासिल गर्नमा धेरै जटिलता थपिनेछ । यस विधेयकमा कयौँ किसिमका डिभी भिसा लोट्रीलाई पनि बन्द गर्ने प्रस्ताव गरिएको छ ।

रिपब्लिकन सांसद टोम कोटन र डेमोक्र्याटिक सांसद डेभिड पेर्डुले यस विधेयकलाई सिनेटमा पेश गरेका हुन् । जसमा हरेक साल अमेरिका आउने आप्रवासीको संख्या १० लाखबाट घटाएर पाँच लाख गर्ने प्रस्ताव गरिएको।

यी सांसदहरुलदे हरेक साल जारी गरिने १० लाख ग्रीन कार्डको संख्या आधा गर्ने प्रस्ताव विधेयकमा गरेका छन् । सन् २०१५ मा १० लाख ५१ हजार ३१ जना आप्रवासी अमेरिका पुगेका थिए ।

यदि रेज एक्ट पारित भयो भने हरेक साल अमेरिका पुग्ने आप्रवासीको संख्या घटेर पाँच लाखमा झर्नेछ । यो विधेयक पारित भएको पहिलो साल आप्रवासको संख्या घटेर छ लाख ३७ हजार नौ सय ६० हुनेछ । र, अबको १० वर्षमा यो संख्या पाँच लाख ३९ हजार नौ सय ५८ मा सीमित हुनेछ ।

सिनेटर पेर्डुले भनेका छन्, 'हामी आफ्नो अध्यागमन प्रणालीका कम्जोरीलाई हटाउनका लागि कदम उठाइरहेका छौँ । अध्यागमन प्रणालीको ऐतिहासिक सामान्यस्तरसम्मको यात्राले अमेरिकीलाई जागिरको अवसर बढ्नेछ भने तलब पनि बढ्नेछ ।'

रेज एक्टमा अमेरिकी नागरिक र कानूनीरुपमा स्थायी बासिन्दाका जीवनसाथी (पति या पत्नी) र नाबालिग बच्चालाई प्राथमिकता कायमै हुनेछ । अर्कातिर खास श्रेणी र परिवारका बयस्क सदस्यको प्राथमिकता अब समाप्त हुनेछ ।

विधेयकमा कयौँ किसिमका डिभी लोट्री भिसालाई पनि समाप्त गर्ने प्रस्ताव गरिएको छ। यसमा भनिए अनुसार विभिन्न लोट्री भिसाबाट ठगी हुने गरेको छ। र, डिभी भिसा प्रणालीले आर्थिक या मानवीय हित पनि पुरा हुने गरेको छैन । रेज एक्टमार्फत यस लोट्रीलाई मनोमानी तरिबाट विनियोजन गर्ने कामलाई रोकेर ५० हजार भिसा वितरणलाई बन्द गर्ने भनिएको छ ।

अहिलेको अवस्थामा नेपालीसहित भारतीयलाई ग्रीन कार्ड प्राप्तिका लागि १० देखि ३५ वर्ष लामो अवधिसम्म कुर्नुपर्ने बाध्यता छ । विधेयकले कानुनी रुप पाएपछि यस अवधिमा अझ वृद्धि हुनेछ । यसले रोजगार श्रेणीमा अधिरका साथ ग्रीन कार्ड या अमेरिकामा स्थायी बसोबासको आशा लिएर लामो समयदेखि प्रतिक्षामा रहेकाले अझै कुर्नुपर्ने हुन्छ ।

ग्रीन कार्ड जारी भएपछि अमेरिकामा कानुनी रूपमा स्थायी बसोबासको अनुमति मिल्छ । तर पनि यस विधेयकमा एच-१ बी भिसाको कुनै जिकिर गरिएको छैन।

रिपब्लिकन सिनेटर टोम कटन र डेमोक्र्याटिक सिनेटर डेभिड पेर्डुको तर्फबाट पेश गरिएको ‘रेज एक्ट’ लाई अमेरिकी राष्ट्रपति डोनाल्ड ट्रम्पको अप्रवासीको संख्या घटाउने नीतिको समर्थनमा ल्याइएको बताइन्छ ।

कटनले भने, 'यो समय हाम्रो अध्यागमन प्रणाली अमेरिकी कामदारका लागि काम गर्न सुरु गर्नु जरुरी छ।’ उनले रेज एक्ट पारित भएपछि सबै कामकाजी अमेरिकीको तलबमा वृद्धि भएर उनीहरुको भविष्य अझै राम्रो हुने बताएका छन् ।

Also, not in the RAISE act but according to Tom and Purdue, they are mulling to control the H1B ABUSE but possibly to increase the 85000 limit. It is not bad for the students or those seeking jobs after graduation.

you got it right sarkozy but my sources says all 50000 goes to h1b raising to 135000 that means mosts stem students here which Trump says wants to keep them in, will benefit a lot, others are probably fear fake news

TBH, Green card lottery visa doesn't make sense to me at all. Why not institute something like Canada where you assign points to an applicant and only those meeting certain threshold gets to apply.

THey should lower the H-1B visa quota, as well as give priority to the students in US.

BadhiJanne, seems like you would benefit from the policy you are advocating. DV was instituted so that not just rich people and highly educated people but also regular folks would also get a chance to come to the United States. Now I know the usual, DV holders work at gas stations and have no motivation etc etc. But those are just anecdotal situations. There are also many very successful "DV walas"

Not trying advocate H1, DV, Student etc and non of those applies to me any way.

But we will always need non-skilled and semi-skilled people. DV fills those pool. They will need to find way to have people willing to work in between 10-20 $ per hour range . It doesn't make sense to bring H1b who will make 100k by cutting those low pay worker. In reality labour shortage is way too high in that category then so called High skilled h1b. And it will be very visiable if they try some sort of border control.

And replacing current h1b with students also doesn't make sense because they are fresh out of college , need all the training and takes atleast 4/5 yrs to be o level companies who really want high skilled people.

They need to find way to get rid of h1b being used by single or few companies , and make tier based system in pay. US graduates can take lower salary for first 5 yes and those they want to bring from other country directly need to pay atleast 130 k, in cali 150k. And no company can use more then 100-200 h1b per year.

That way quota will be available , students have path to get into system, and those really high-skilled one can also come in. But they still need to find way to make sure they don't keep opening small companies to bring people in.

I agree that the abuse in the system needs to be taken care for. There have been significant drop in IT sector salaries compared to a few years ago and many people have lost their jobs. An extreme example is what happened in Disney. There does not seem to be as big a problem in other tech fields as compared to IT by the inflow of h1b visa workers.

There is also a case to be made that American graduates and job seekers should be given preference over foreign students and workers. I think most countries around the world has this policy. However, there are plenty of tech jobs that cannot be just satisfied by american workers and hence there is a need for h1b.
