NATIONAL TPS ALLIANCE, DENIS MOLINA, JHONY SILVA, MARIA ELENA HERNANDEZ, O.C., SANDHYA LAMA, S.K., TEOFILO MARTINEZ Plaintiffs, v. KRISTI NOEM, in her official capacity as Secretary of Homeland Security, UNITED STATES DEPARTMENT OF HOMELAND SECURITY, and UNITED STATES OF AMERICA, Defendants.

The lawsuit alleges that these terminations violate the Administrative Procedure Act (APA) by disregarding country conditions and instead relying on a predetermined political decision to dismantle the TPS program. These terminations follow on the heels of the vacatur and termination of TPS for Venezuela and Haiti, and the terminations of TPS for Afghanistan and Cameroon.

Good Luck! Kudso To Adhikaar again, They deliver. (twice now)

Looks like it is only filed in California district court. Supreme Court le district court ko nationwide injunction power limit garya cha. Aba tyo court le roke pani teskai jurisdiction ma matrai lagu huncha hola tyo nirnaya. Dherai Khusi huna parne jasto chai kehi dekhdina hai ma chai.

I do not see Adhikaar listed as a plaintiff in this case. The lawsuit is asking for relief only for the named plaintiffs and members of the National TPS Alliance. So even if the court grants an injunction, it would only help those specific people, not anyone from Adhikaar or its members. It also seems that only Nepalese individuals who are members of the National TPS Alliance would receive relief.

Also, the other day the Supreme Court made a decision that supports this idea. It said relief in a case should only go to the people directly involved, not to everyone else.

Lawsuit excerpt:

NTPSA brings this action on behalf of its members. The vast majority of NTPSA’s members are TPS holders, including TPS holders from Afghanistan, Burma (Myanmar), Cameroon, El Salvador, Haiti, Honduras, Lebanon, Nepal, Nicaragua, Sudan, Ukraine, Venezuela, and Yemen; the rest are family members of TPS holders and other individuals who wish to support the TPS community.

The NTPSA has approximately 300 Honduran TPS holder members living in 22 states; approximately 900 Nepali members living in 40 states; and approximately 25 Nicaraguan TPS holder members living in seven states. They face irreparable harm from the challenged terminations.
