Judge ask DOJ to Explain Detention Timeline for Nepali TPS Holders before deportation
On July 25, 2025, Judge Thompson filed an order posing numerous questions to both parties and requiring written responses by 5 p.m. on July 28, 2025.

Judge Thompson asks both parties to explain how the Winter factors apply to the delay motion.

In my opinion this question about detention time is very good. It shows how long Nepali TPS holders might stay in ICE custody, from a few days to many months. This information gives clear proof of the serious harm they would suffer if TPS ends without a delay. It also helps the judge compare who would be more hurt and makes sure the court protects their right to fair procedure.

A top DC attorney said that after reading Judge Thompson’s five pages of questions, she seems to be on the side of the TPS holders. She asked so many questions to make sure she had all the facts for the best decision. Even if the government appeals, they might lose because the district court already looked at everything.

Today is a big day. The judge was appointed by Biden so she is probably going to be a little considerate of immigrants. Hoping for the best.
