NATIONAL TPS ALLIANCE, DENIS MOLINA, JHONY SILVA, MARIA ELENA HERNANDEZ, O.C., SANDHYA LAMA, S.K., TEOFILO MARTINEZ Plaintiffs, v. KRISTI NOEM, in her official capacity as Secretary of Homeland Security, UNITED STATES DEPARTMENT OF HOMELAND SECURITY, and UNITED STATES OF AMERICA, Defendants.
The lawsuit alleges that these terminations violate the Administrative Procedure Act (APA) by disregarding country conditions and instead relying on a predetermined political decision to dismantle the TPS program. These terminations follow on the heels of the vacatur and termination of TPS for Venezuela and Haiti, and the terminations of TPS for Afghanistan and Cameroon.
Good Luck! Kudso To Adhikaar again, They deliver. (twice now)
I do not see Adhikaar listed as a plaintiff in this case. The lawsuit is asking for relief only for the named plaintiffs and members of the National TPS Alliance. So even if the court grants an injunction, it would only help those specific people, not anyone from Adhikaar or its members. It also seems that only Nepalese individuals who are members of the National TPS Alliance would receive relief.
Also, the other day the Supreme Court made a decision that supports this idea. It said relief in a case should only go to the people directly involved, not to everyone else.
