So my company wants to file my GC under eb3 and i wanted to know how will it take to receive the card in my hand once they start the process. Also my company might be bought out by another company in the near future, so will the GC process keep going or the new company has to file a new one? Please help.

 agree with bi-polar.

 plus if your company bought by other company in the near future, your process will be affected.  You might be started the whole process again from zero level.

 My company has already filed for my green card under EB3. I have already waited for 2 years. I have been with the company for around 5 years now and I think I want a change. Overall I have around 6 years of experience and want to change my green card processing to EB2. What are my options given that filing EB2 from the same company is not an option as it seems a little complicated and I just don't see any more growth in my carrer with this company?

If I'm not mistaken (I'm not an immigration expert),

I don't think your company can file for your Greencard until your PriorityDate becomes current. What is your PD? Right now according to the visa bulletin (USCIS), the current date is for May 2007. Meaning, those people can finally file for their Adjustment of Status (I-485) - who filed for their Labor (PERM) on May 2007.

If you have waited for 2 years, your PD is probably for Feb 2011. That means you have to wait for another 4 more years (with the current linear trend) to be allowable to file for I-485.

Ekduiteen,

Here are your options(IMO):


- Start hunting for jobs, Since you already have 6 yrs of experience, In most of the companies after 7 yrs of experience you're considered  as a senior. Although companies hate to start the H1B process, esp the HR people, it's all upto to the hiring manager and his/her manager. If you can sell yourself, they'll hire you and  sponsor you. (It's worth trying)

- Talk to one of those Indian consultancies, most them are willing to sponsor you on EB2, since you have good experience and less  risk and they can consume a good part of your hard earned salary for atleast 2 years.

- Continue working there and hope for a miracle  if Immigration reform will indeed happen.

 Thanks for your input bi-polar. It doesn't look like there are many options and of all these options, the first option seems the most attractive to me. However, I'm reluctant to send resumes around as my boss might find out and I might end up loosing my job.

Really? I don't think your boss will fire you just upon looking at other opportunities. Post your complete profile on LinkedIN. That's the new nesting ground for head-hunters. Besides, you can always tell your Boss that you're actually evaluating yourself with the market to see the areas/skills of improvements. C'mon unless your're working for a very small company and your  boss is the owner, he wouldn't care less.

 lol...It is not exactly a small company (we have around 30 big companies as clients)..but, my boss is the owner.

 I think the "reform" focuses mainly with illegal immigration. I don't think there are specifics on how it will change the legal immigration system. However, my hope is that it will have a positive impact on existing processes as well. I guess we will find out..

So currently i have a bachelors and 3 years experience but the job description is bachelors +5 years experience. Will i be able to file under eb2?

 as far as I know, you either need to have Masters or 5+ years experience to be able to file under eb2. I think they look at the experience in your resume and not the job description..but, verify with a lawyer.

Anyone knows if our Master Degree Major Matters for EB2?

 I have Business Bachelor’s degree I but currently working in an IT field and trying to finish my master degree in Business as well before I apply for EB2. Spoke to HR to see if they will have problem applying for my green card with Business degree in master but they don’t think that will be a case.

Any idea, guys?

any immigration lawyer should be able to answer your question. If the company you work for has hired a lawyer for your stuff, you should just be able to ask them. Otherwise, just Google for immigration lawyers in your area and setup an appointment.


phukservantofgod,

I think your major should be in the same field as your area of work.

Again, don't take any major step in your immigration status without consulting a professional.

MS plus ZERO years of experience or BS plus FIVE years would qualify for EB2..Good luck Mr ktm_rider
