Hi,
I am currently under EB3 category. I have worked 5 years into this job and would like to change it to EB2. However, my lawyer said i am unable to file under EB2 although i have 5 years of experience. He gave me a weird explanation that i did not comprehend. The work i am working does not match with the degree i graduated from. That is the only explanation i can think of for not being able to change it to EB2. I also have masters degree but my job only requires a bachelors degree as a minimum qualification requirement for the job. Is there any other way to convert EB3 to EB2? Help much appreciated..

If your job doesn't require Bachelor+5 years of experience or master's degree then yes your lawyer is right. What is your degree of graduation and in which field you are working on btw?

For EB2 eligibility: Your job should require Bachelor +5 years experience or Masters degree during the time for hire.
Experience acquired during the job is not counted for eligibility for EB2. Working on same job for 5 years does not automatically qualify for EB2. You probably need to find a new job that requires +5 years of experiece or Masters degree PLUS company is willing to do EB2.
EB3 is waste of time...
Bottom line, its your job that should require Masters degree or +5 years of experience.

i don't think i have much of a choice right now. i can't change the company because the current company is a non-profit company and its hard to find an H1B-transferrable Non profit institution. i know EB3 sucks but at least it is better than not finding a job at this current economy...
