If, however, an employer enrolls in E-Verify to retain the employment of an OPT student, the employer may not verify the employment eligibility of the OPT employee in E-Verify as the MOU prohibits the verification of existing employees.........  see.page 19

This new OPT rule if passes, the OPT will be extended to a total of 29 months. Which means if you have already started your OPT you will get another 17 months more. however the company you are working for must participate in federal e-verify program which allows the employers to check if you are authorized to work. In the event that the company you are working with does not participate in e-verify, they can sign up for it if they want you (OPT category) to keep working for them. Since you will be an existing employee they don't need to or shouldn't verify your eligibility to work. It will be applicable to new employees only and they must do it for all new hires.

are they signed up for e-verify? if not they need to if they want to keep an OPT student who will file for the 17 more months extension, only in the scenario that this law passes
