Starting August 13, 2026, traveling outside the United States with advance parole counts as leaving the country.
If a person had more than one year of unlawful presence before traveling, the trip may trigger the ten year bar and could prevent them from getting a green card without a waiver.
This new rule applies only to trips taken from August 13, 2026, forward. It does not apply to advance parole trips taken before that date.
