 Friends,

I am working in university sponsored H1B visa from last 2 years, unfortunately I will be laid off end of this month(31st aug). What are my options now?  My friends are suggesting couple of different options

Like:

going back to school (so F1)

going to desi consultancy for job placement with new H1B (I can start working without training)

find new job and transfer H1B(which is very difficult in this economic situation)

applying for B2(tourist visa) and find new job within 6 months

For F1: It’s already late to apply for fall sem in public universities.. so, no I20 until next sem, but some private universities sem starts from October and also Kaplan is there. I am thinking about joining MBA though I already have master in computer science.

My question here is does USCIS cares what type of university and degree I am joining, while switching H1B to F1? what are the chances of USCIS deny H1 to F1?

And going to Consultancy I talked to one consultancy they said they will find job for me but all with exaggerated resume.  Question here is, If they sponsor H1B , what happens If they can’t find next job on time(beach sitting)

which is the best option for me , when should I file to USCIS 

 Any suggestion is appreciated.

As I know,

it matters what kind of  university you are joining, and there are lots of kind of 'if' and 'but' for this process.

Best option would be Join Kaplan for GRE, and USCIS sends you RFE, say ' want to go for PHD, so wants some good grade on GRE'

If it is University sponsored H1, there is very little option of transferring it. These H1 sponsored by non-profit institutions are exempted of 65K quota cap, and can not be transferred to any oher job type (profit making companies).

Your options are - either go to school or talk to some company and get job and ask them to sponsor new H1. I am not sure of second option though.

 Ya, It's university sponsored H1B. 
I am also considering F1 as best option but confused weather to join Kaplan  for GRE preprn or to join some cheap private university for MBA.
Not sure How long I can stay in Kaplan?

any other thoughts?

If you have good relationship or can convience them that they do not revoke your H1B from USCIS, then you can stay as unpaid vacation. Even if you are in vacation and unpaid, you will still maintain your status. This may be one of the options.

@it_guy

if no new job offer with in this week. I decided to join university, so back to F1.

one question: my employer offers layoff severance package(including health insurance, unemployment benefits................) , Can I take some of those benefits like health insurence?

Any suggestion is appricited.
