 H1b Extension beyond 3 yrs

Hi guys!

I heard that for H1 extension beyond 3 years, one has to go to NEPAL.

How true is it ??

Any idea please share.

I don't think so. 2nd 3 year renewal can be done here w/o going to Nepal. If you do go to Nepal or anywhere out of the US(except Canada/Mexico returning within 30 days), you'd need to have your PP stamped with the H1B visa though.

I have done it several times from USA this H1-B Extension beyond 3 years using following criteria: you don't need to go back home unless you want to stamp visa on your passport(Visa revalidation which also can be done i n mexico or canada if you have approved h1 copy)

1) Labor certification must be filed 365 days before the current H-1 Expiration date and is either pending or approved.  I
  You will get 1 yr extension
Or
2) I-140 must be approved and current visa bulletin must be unavailable to file I-485(doesnot matter when you file your labor certification in this case)
  You will get 3 yr extension

Sorry, I meant beyond 6 years.

Beyond 3 h1b ext, you can do anytime from USA with out any restrictions as long has you have a
1) Job
2) Is being paid prevailing wage per state labor dept requirement for your job title
3) need latest pay stub.

I am currently in US in H1B visa(visa expired). I am going to canada to get my PR (permanent residency). I am planning to come back within 2 weeks. I also saw this in http://murthyforum.atinfopop.com/4/OpenTopic?a=tpc&s=1024039761&f=4724019812&m=7261020931.


The notice from USCIS pasted in the murthyform says that the nonimmigrant alien much be in possession of a Form I-94. I believe we have to submit our I-94 while going out of the country. So how will we be in the possession of the I-94 when coming back.
