I missed the H1B this year and I am facing some problem. I am currently working on CPT (curriculum practical training) and it expires on 02/01/2007. I talked to university and they will extent it four more months i.e. till 06/01/2007. My company said me that they can file the H1B on next April 2007 where currently I am working. My question is can I still remain in USA without doing any thing in valid status after filing H1B on April 2007 from 06/01/2007 to 10/01/2007? Hope you understand my problem. Thanks

hey SajNep71, I completely understand ur situation cuz i'm in same situation too ... well, worse than urs. Im on OPT and it expires same date as urs does. But with OPT I can't even extend it. Atleast u have CPT and u can extend it so push your universirty to extend it for 8 months. Otherwise u'll have to either go back for 4 months from 06/01/2007 to 10/01/2007 or go back to university. I'm assuming ur on ur bachelors right now. Please let me know if you come up with something brillient that goin' back to school or nepal.

Hi Problems101, Your situation is not bad because you have masters degree from USA and there are still cap H1B for this year and since your OPT is going to expire only on next year you don't need to worry about it. Thanks

U will have to have be in some valid status. You cannot be out of school. Some attorneys and schools say that u have to be F-1.

sanjnep71, he is what I know. But rules may have changed so your lawyer would have more information. Say YOUR CPT expires in APR2007 and your H1 is filed from JUNE2007. Provided that your H1 is filed before APR 2007 you can stay in US because you already filed for your change of status and awaiting decision on the petition. Since you are/were in F1 you cannot WORK for the PERIOD between APR2007 and JUNE2007. If the company LIKES you. [ does not matter .. FORTUNE 100 they all the same]. you can work and they may pay you for those months OFF THE BOOK or PAY YOU as a SIGN IN BONUS AMOUNT.
