 Applying Green Card EB2

Hi Friends,

My Company is filing for my green card. I have a three years bachelors from Nepal and Masters degree from US and arround 3 years of work experience in US.
Is the Education and work experience enough to apply GC in EB2. Any experiences please share.

AFAIK, Masters degree is sufficient condition for EB2.

Job Requirement is the only thing that matters while Applying for GC..If ur job requires only a bachelor degree even though you have master's degree in hand You can't file on EB2.

And salary needs to match the EB2 category along with MS degree or BS degree with 5 years experience.

I have a job which doesnt require masters, so can i file my gc? I only have undergraduate. Degree and right now on h1b..... What is this eb2 category. Can i file gc with undergraduate degree on eb2 category?

Nepalism, Salary can be 10 % plus minus of the prevailing wages.

welcome to the world of over-educated yet under-privileged !! After two master degrees, 5 years of work experience all I could convince my employer was an EB3. Reason given, the job I perform does not require anything more than a bachelors. In reality I succeeded someone who had 15 years of experience with bachelors degree, who succeded someone with 18 years and a masters degree - Note the word succeeded and not displaced as in displaced due to lower wage. These people left on their own accord and the management decided that I had the skills to do the job. I am also paid at the same rate these people were at, which is very much in the EB2 prevailing wage range.

This is my life and then you talk to friends and find that data warehousing, software testing and production support jobs suddenly require Bachelors + Five years of experience or Masters degree and hence qualify for EB2. I am in no way undermining the ability of people who do these jobs or have a prejudice against these positions, its just that the system needs to be repaired to ensure the right person enters the right queue in an immigration process. Like some of our friends have already mentioned above, as long as you have a masters degree, you are qualified for EB2.
What is important is that your position should REQUIRE masters degree (if you have a masters or higher degree but your job just requires a bachelors degree, it doesnt qualify you for EB2).
So, to sum up- two conditions; 1) your job requires someone with a masters degree, 2) you have a masters degree. With thesetwo conditions met, you can righfully file for green card under EB2.

As said, master’s degree by itself is sufficient to be eligible for EB2. Most important part is your employer should agree to make the job requirement needing master’s degree. Having said that, it’s better not to include 3 years of experience as job requirement after Master’s degree even if your employer agrees. If the job requirement needs years of experience after Master’s degree, it is very likely that it gets audited compared to job requirement that needs only master’s degree and no experience. Any job requirement that crosses the SVP level of 7 is likely be audited as per LCA form. Master degree by itself makes the SVP level of 7. Adding any years of experience makes the SVP level go beyond 7.

It’s luck to those who didn’t get audited even if their job requirement was Master’s + x years of exp.

As far as I know, you need 4 years Bacholers and 2 years masters for EB2.  I think your 3 years bacholers from Nepal might be an issue so better consult with a good lawyer.

These days uscis is saying 3 yrs bachelor + 2 yrs masters is not equivalent to us masters. Does not have 18 yrs of education. So could be denied at I-140. But as we all know every thing depends on case by case. If your employer is desi crap be careful.

Mitra haru, sab jana ko comment haru dekhera malie pani kehi kuraa share garna man laagyo, I hope I can share some insight...

1. Job requirement dictates if it is EB2 or Eb3 (example if your company has 14 job title Computer Porgrammer as a bachelors requirement, they cannot apply you as Eb2 candidate.. No matter if you say senior computer manager or lead computer programmer.. in order for lead/senior to be different than a regular computer programmer your job function has to be 50% different than that of a computer programmer which is hard to prove, you are better off selecting a different job title.. Like a computer manager )

2. A US degree prevails everything.. If you 3 yrs of bachelors or 5 .. A uS degree will qualify you to apply as an Eb2 candidate, if the job requires such..

3. SVP, where does it come to play --- If the processing officer decides to $crew you, it plays a big role.. check out flcdatacenter.com.. Most IT and business job has a maximum SVP of 7.. A master degree itself will give you a SVP of 7 or a bachelors degree SVP3 and 4 yrs SVP 4 = SVP7.. If the processing officer has a hard day.. and comes across your application where it says Bachelors + > 4 yrs or Masters + >0 yrs.. He can ask you for business necessity which will send you back to the queue and you will need to wait for 2 yrs before he will take a look at it again.. The best bet is if you have a master degree apply as Master + 0 yrs experience.. That is your safe way to the promise land..

For guys that has bachelors degree abroad...

Although rules are tough for ppl overseas.. Because at any point of time they can say business necessity and push you back in the line asking for a degree evaluation.. Although ppl have applied with bachelors + >4 yrs experience, as I said it depends on what day the processing officer has.. As per the DOL rule they can always ask for more reasoning if they find your application has surpassed their guidelines of SVP.. Totally depends upon them..

As far as the salary and job title are concerned .. Please let me bring into your attention that an employement based Green card is for your future not present, that is why it is recommended that you stay with the company for one year after you get your green card.. Although You must be very close to the Salary range

example - If your salary is 65K and your PWD is 95K .. Your company must show that he has 30K additional in profits that he can pass it on to you.. But if your salary is 90K then its matter of 5K .. remember you are part of his expense so your salary is already accounted when he calculates his profits..

My case is little different.  I got approved with H1 B even though i wasnot working previously. I wasn in bench. You know how dhoti consultancy works. I went to nepal with H1 B , got married and bropught wife with me as dependent,  :))))). Nepalese embassy couldnt figure out that I wasnt working. Now I have a job and consultancy wants to file GC with EB2 . Now my question is will they be able to find out my previous  activities?

Mero dada le pani Eb2 category ma nai virginia ko consultancy bata GC payeko ho. Usle dherai nai chadhai payecha GC, dont know how, whther he fulfilled all legal procedures, anyway happy that he got it fast and put his wife in the process.

 everybody is lying now a days. they say eb2, dv, blah blah but file asylum from california. if he had done eb2 then your bhauju would've gotten the derivative gc at the same with your bro.

Is there any difference in terms of getting audited of process of filing lobar certification in EB-2 category from University or from company like Desi or others??? Does University sponsored case gets less audited? What historical data shows?

Friends.. i started this thread arround 8 months back when i applied form my PERM. Today i am updating it as i got my green card.
So according to my experience .. Three Years Bachelors and US Masters works.. for EB2.

First of all congratulations.

I am exactly on the same boat where u were 8 mnts before. I am on h1 and my h1 was applied with bachelor's degree. Now i have masters and want to apply gc on eb2 category. But i have heard that i cannot use my experience gained with current company and application should be placed with new position. I hope u understand what i am trying to ask. Can u please share your experience on this?
