Hi,

Can someone please tell me how long it takes for me to get green card after I get marriage with my future husband when I am in US? He has a green card only.

If I am in Nepal is it possible for me to come to US in dependent visa? If yes how long does it take?

Sincere responses will be appreciated.

Thank you,

Rita

first of all don't bother the fake name; Rita. second if you love the person, his green card , citizenship etc should not be the matter to consider. but  i understand not all marry for/because of true love etc etc.. so if you're marrying for immigration benefits then i suggest marrying a citizen instead.

Rita, I suppose you are in Nepal. There is no dependent visa for gc holder's spouse or dependents. If you get married in Nepal, your husband should come back to the US and file form I-130 with your marriage certificate and it will take about 6 months to process. After that you will apply for immigrant visa and come to the US. So, you will be in Nepal for at least 6 months after marriage.

Rita,
Why are you so worried about GC if your marriage is genuine? You should be worried about how long you need to stay apart from your husband after marriage. Eventually, you will get a GC but you can start working in less than 2 weeks after your arrival in the US (2 weeks because of time required to get a social security number to work legally). If you wanna start a business, your husband has enough paperwork.
I suggest that if you are capable, apply for a student visa to the US and come with your husband soon after marriage. You don't need to wait for 6-8 months until your I-130 approved. After you land in the US, register your marriage and apply for your GC. Not sure but it will take 6 months either way.

"Why are you so worried about GC if your marriage
is genuine? You should be worried about how long you need to stay apart
from your husband after marriage."

These are the best words I heard from furke in sajha.. :)

Rita,

First thing, if you are marrying just for GC, it is sad.

OK, now to your questions -
Most of my friends with GC are not able to bring their wife to US (couple of their applications were rejected by US consulate in KTM..). Now these guys are waiting for them to be US citizen (that takes about 4 yrs after having GC), so that they can bring their wife. This is usual scenario. (Not much idea on furke's way of getting gc in 6 months..)

If you wanna be in US and get GC fast through marriage, your option should be rather those guys who have master degree in special category (e.g. IT) and  genuinely working under H1B visa. They can bring their wives easily and green card can be faster (except few cases) through employers.

Still, these are very generic info, and it might not be strictly valid for each and every individual cases.

The safest way to get to america is to get married with US citizen. That is less hastle and the spouses get their temporary green card within a month after they enter US. Talking about H-1, used to be good when the economy was healthy. Now people are doing everything to keep  themself in H1 as lot of people has lost their H-1 due to the jobless economy. In another words when a person does not know if he or she will be able to keep his H-1 successfully until he has his green card, than for sure you know you will be a pendulum as the future of yours lies on a big uncertainity. Marrying with green card used to be 3 to 4 years, but dont have the latest update on this. For sure there are cases in green card whose spouses came after 7-8 years but i am pretty sure they had some immigration problems.Lastly, even if you are in US and you marry a green card holder, you have to wait that 3 to 4 years for your papers.

As he already has a greencard, he should have an idea about all the process and time frame for you to get the greencard. The best person to discuss about this is him if you can trust him.

GreenCard Holder : It might take 2-3Years to get in US . One of my friend had to wait for 4Yrs cause their Process kept on pending for long time.
If it's  US citizen's case it takes around 1 yrs-16months or less .

I agree with most of the guys saying that marriage for just GC would not be appreciable. It depends on many thing (about your हुनेवाला पति). Few I can remember are, how good is his credit history, Tax return and other things.

I think if he just recently got his GC than it might be difficult for your  come to you. Even with you GC the embassy in US asked all sort of question to verify that you two are married for good reason( not only for GC).I am telling you coz I have overheard the visa interview for a case similar to yours during one of my trip to US embassy ion KTM( I even heard that the consular asking the lady like why you need पोते or which side of the bed you people sleep I just heard it from other people and I am not sure how much it is true)

I think if you are capable I think F1 for you is the best you can be with your husband and at the same time be in US while the process of GC for you is going on. N who know you might even get a GC for yourself without your husbands help.

Regarding F1, one fellow wanted to bring his wife during his green card had problem ( embassy checked and found out about marriage). Could not bring his spouse for a long time though he has every thing to support it.
If you can do not invite problems.

Are you really in Nepal?

I don't think so.

A F1 student who has not even applied for an interview date at US Embassy in Nepal would never think of getting a GC as soon as he lands in US.

However there are lots of problem to get immigration visa for the spouse who gets marriage with Green card holder and who is outside the United States. I have not seen even single case that the spouse got the visa within 2 years. But what I have heard that it also depends on the credit history of the person who has green card. The best and easies way is to try other non-immigrant visa first and then after been in US, file Green card.

what's credit gotta do with immigration. i have never heard that before. yes, maybe public charges such as filing disabilities etc maybe asked and can be held against petition .. my personal experience with immigration and knowing many others who i know personally who have brought their family members over with fked up credit don't let me believe on that crap.. sorry...
btw, no offense but most of you guys giving expert opinion about immigration here, do you guys even have a green card?
i mean, i don't preach about biochemistry cuz i have never taken that sure i can google about it, look into Wikipedia etc but i would still not go teaching people about the subject matter just based on those things... you know what i mean...
