since H1-B creates lot of mess, i've  to go back to school again which i really don't want to.
my spouse's visa was rejected when s/he applied  for F2 and visiting visa.

i heard US embassy  in kathmandu is very strict these days. do u guys think it might be worthy to apply dependent visa again?

or,any other way to bring the spose here?

ek@l, It's sad to know that your spouse's F2 and B2 visa was rejected. Consulars in Kathmandu embassy dont need any concrete reason to reject anybody specially spouse. I dont know why they see problem with spouse thosedays. Financial problem/potential immigrant ... are their common reasons and they wanna play with the feelings of the couple. They dont see any problem in issuing visas to even far relatives of similar cases but they are 'negative' in F2 visas.

It really sucks.

It's difficult to get visa again unless your status becomes H1B or at least a TA/RA job in your new admission. If you are trying again, dont forget the corrections to be made both in financial and academic. Good luck and dont give up your hope.

Please give detail about visa rejection, my wife is get rejected, I am working in good company but I am in OPT. Let me know about your case so that we can work together.

thanks for sharing guys.

actually my spouse applied F2 when i went to nepal on 2006 december. that day one nepalese guy broke some glasses inside the embassy when his visa was rejected. may be that was the very bad day. nobody got the visa. she is the one who came out last on that day. though they kept him/her inside for long time, they reject. they did not say anything except, "your spouse is almost there to finish his/her study, it si not worthy to travvel for short period"

later on s/he applied again on my graduation. that time s/he was not planning to stay here as an dependent. s/he was on her final semester back in nepal. s/he told the visa officer that s/he is just going to attend the graduation and will come back to take the final exam. but  that time also rejected. US embassy  told her "once your spouse have H1-B, we will issue the visa. we can't stop you at that time".

Now my H1-B ----not withdrawn. I have only few options (I) go back to nepal; which i really don't want to do on this terrible situation (2) go back to universtiy and apply on dependent (3) let my spouse apply F1

i don't know which one is a good

 

BTW, timer, don't let your wife apply dependent visa when you are on OPT.

STAT, Thanks. i'm planing to go back to the university for another degree rather than community college to maintain the status. i will try RA/GA this time. lets see what happen. but man, US embassy in Kathmandu really sucks. i have seeen they have issued the visa to some nepalese who are in community college and applied F2 for their spouse. i don't know why they treat people differently.

Now i  am in same situation, I have got really prestigious job, supporting government with good salary, I have 7 months left for my OPT but, they didn't even listen anything and directly rejected. I have good amount in bank too, do you guys think, there is no possibility if she apply second chance. It is just one week ago.

timer, don't do it now.

i just talked to my university's advisor and immigration officer this morning. dependent is very difficult. though i'm going back to school, i might let spouse apply F1 visa for Spring 2009.

yes, you are right. but I am in process of OPT extension now. I didn't hear anything about H1b but I am thinking to re-apply again after OPT extension. But still no hope. I don't want to go school again, because there are again the funding issues and still there is no guarentee in F1(for wife) in Ktm. so at this point, I think, I will try again once in Opt. I have written to US embessy to ktm and asked why they rejected the visa. They mentioned that probably your time period in your I20.

let's see what would happen.

OK. I can't get my OPT extension being on MGMT field therefore I've to go to the school to maintain the status. I might let my spouse apply on F2 once I get new I20. But my advisor suggest me to apply on F1 from KTM. I've not decided yet. Its really complicated.  I might let my spouse  apply on F2 one more time just to try. but i'm thinking seriousl to apply on F1. May be for MBA, US embassy will consider the application favourably.

Seriously man, I'm tired. My spouse understand the problem but the relatives.........................keep asking the same question over and over........"Kina visa apply nagareko etc.",  they think .........you know what i mean

anyway, keep in touch. i'll inform you if i get some more information on this issue.

Ek@l and timer,

I feel bad for both of you guys, one thing I would like to highlight is "honesty". I am clear on Ek@l's situation but for timer, when you are reapplying for a US visa whichever category, make sure that you check off "yes" under the section where it asks you"have you ever applied for a US visa before". So, whether you got rejected or not, pls, indicate "yes" and write as to why the visa got rejected.

Regarding Ek@l's relatives nagging him all the time, is understandable but I know it can get really frustrating. I did not realize that they would toughen so much on the F2 visa. I have seen so many spouses granted F2 recently even from community colleges. If you are planning to do your Masters degree, you will have a new I-20 for may be a period of 2 -3 extra years. Why dont you give it a try and see if your wife can get F2 with this new I-20?. Your spouse's visa has already been rejected x2. You can try her in F1 but it is not a guarantee, and are you both able to handle the pressure of being and Intl' student in this country? It is upto you.

your spouse will get in F1 if she get I20 from a reputed college even if you have to pay for full tuition first sem. . If her educational background is good and her GMAT or GRE or toefl is really good, I think they will not reject.

Finally, i will get new I20 this week.. 

I'm thinking to let m y spouse apply F1 instead of F2.  But i'm littlebit worried coz we both will b on F1 and US embassy will know it for sure.I've decided to go back to the university instead of community college just because embassy could reject the visa whether if is F1 or F2 if they think that i'm just maintaining my status here.  I really don't  know whehter this decision is good or not but hope this will workout well though financially it is a bad decision coz, I really don't need two degree and I don't want either.

To be honest, I really want to go back home. But.............its not easy. I just can't handle the situation if i return with a piece of paper.  I will try one more time.  Lets see.

Now, if anybody have an idea, I would like to request you guys to share.

Pls suggest me, which application sounds good at this point for my spouse, F1 or F2.

Appreciate your reply with reasonable comment.

I would say try for F2 one more time. I did the same 2 years ago though. get a F2 I20 from schoo i sent my transcript, bank statement and affidavit of support (I134). tell your wife to take some of your marriage pictures

Three basic rules for Non immigrant Visas:
  1. Non immigrant Intention or temporary stay - You can document this through presenting job evidences in Nepal. Include pay stubs, appointment letters and most importantly leave approval letter for the period you have mentioned on the form DS-156/157. In addition, present evidences that your stay will be temporary "outside" Nepal viz You are definite to come back. Evidences of such may be but not limited to visa stamps of other countries in the past, "genuine" reason of temporary stay such as last few months of spouse's education in the US, graduation ceremony, summer break tour, winter break vacation etc. Requesting visa for short period such as a month to 3 months may be beneficial to demonstrate your intention.
  2. Strong Social and economic Ties with Home country - Evidences may include property ownership documents such as land ownership certificate, house-land tax documents, income tax document, company ownership/shareholding documents etc. A spouse or child who remains back in Nepal while you will be away for a short period in the US is a primary factor too. Documents evidencing your social strata and involvement such as certificates, awards, membership of leading organizations etc may look bleak but are very strong in terms of proving your stance. If you own a company or your family has a traditional business, include business registration, tax registration and share holding pattern. Yes, even though you have your own company, you have to include a Board Resolution approving your leave of absence and if any financial assistance is being offered. If you have strong recommendation letters from nationally known figures who mention that they know your personally and that they firmly believe that you shall return back, proves to be more supportive.
  3. Financial Ability: Documents such as pay stubs of you and/or your spouse, Affidavit of financial support (Form I-134) from the spouse in the US, evaluation of land-building, bank statement along with last 3 to 6 months of regular transaction in your name or any of your family members (supported by a notarized affidavit of support for sponsorship - see figure), etc. The more the better.
Once a visa is issued, ensure that you return or extend/change your non immigrant status. Being out of status and overstaying for less than 180 days bars from reentering the US for 3 years while overstaying more than 180 days may bar you for 10 years.

Disclose everything honestly on the forms. Discrepancy on the visa form data and fake documentation 'flags' you for sure.
