 I think Matrika Yadav did right thing, what do you think?

Hi guys, When I read this story, I thougt this is too much, Matrika Yadav should get punished for his action. But after I read his statement today in a Newspaper, I realize that may be he did the right thing, corruptions is spreading like cancer, we would be leaving Bangladesh behind soon.

I know and I support that nobody should take law in their hand excpet the authorized personnel, but some time you have to close your eyes for sake of society and country.

 

 भ्रष्टलाई थुनेकै हो, अरूलाई पनि थुन्छु’

काठमाडौं, (नेस) वन तथा भू-संरक्षणमन्त्री मातृका यादवले स्थानीय विकास अधिकारीलाई आफूले ट्वाइलेटमा थुनेको स्वीकार्दै त्यस्ता भ्रष्टलाई थुन्नु नै पर्ने बताउनुभएको छ।

व्यवस्थापिका-संसद्को हैसियतमा बुधबार बसेको संविधानसभा बैठकमा सभासद्हरूले उठाएको जिज्ञासाको जबाफ दिँदै मन्त्री यादवले भन्नुभयो- भ्रष्टाचारीलाई थुन्नैपर्छ र म वन मन्त्रालयमा छउन्जेल कुनै पनि हालतमा भ्रष्टाचार हुन दिन्न।’

र्ँकर्मचारी थुनेको विषयमा छानबिन हुन्छ भने होस्। त्यसमा मेरो पनि सहयोग रहन्छ’ -मन्त्री यादवले अन्य भ्रष्ट कर्मचारीलाई पनि थुन्ने काम हुने चेतावनीसमेत दिनुभयो।

भ्रष्ट, फटाहा कर्मचारी होस् वा अरू कोही त्यस्ता कसैलाई पनि आफूले बाँकी नराख्ने बताउँदै मन्त्री यादवले भन्नुभयो- दुगन्धित व्यक्तिलाई दुगन्धमै राख्नुपर्छ भनेर ट्वाइलेटमा थुनेको हो।’गल्ती गर्नेलाई कारबाही गर्दा मैले कारबाही भोग्नुपर्छ भने म तयार छु। तर म जहाँ रहे पनि भ्रष्टलाई छोड्दिनँ’ -मन्त्री यादवले भन्नुभयो।

प्रहरीलाई जिम्मा लगायो भने प्रहरीसमेत मिलेर भ्रष्टलाई एस्कर्टिङ’ गर्छ र सफाइ दिन्छ। त्यसैले आफैले कारबाही गर्नुपरेको हो’ -उहाँको थप भनाइ थियो।

Who the hale Mr Yadav to judge right or wrong?There should be a mechanism to punish..How can you just call people and start punishing?..

How can anyone dare to punish people who has been serving their nations even before these COMMIES started their so called revolution..

 

Mr Yadav might have psychological disorder and he should be relieved from his post..

He might have had good intentions, but for god sake where is the law and order thing in Nepal? I wish we had strong and independent judiciary system as well as police who could take these actions( not locking in a toilet though) and punish guilty as per law.

Matrika Yadav has shown his not so suitable behaviour for a minister in public so many times.He might have had good intentions in his mind to punish the bhrashta but I don't think he has any right to do that by himself. He should have used his position to call upon AKHTIYAR or BISHESH PRAHARI  and have taken steps as per law of NEpal.

Nobody should be above law. It's not ideal.BUT THEN HOW MANY THINGS IN LIFE ARE? sad  but true.

Ya ya, everybody tries to justify their actions as far as possible. They tried to justify 13000 murder saying they did it for people and punished the guilty only. But basically there are two things that need to be considered. First is do you have enough proof that you are sure that it is not the wrong person. Second is are you authorized to take action. There is a little difference in true dictator and a true patriotic leader, at least they both think they are right.

Corrupt person like LDO is himself corrupt, no doubt. Then, police force, which is supposed to arrest such corrupt LDO is itself corrupt. It's won't do anything as long as it gets money or other benifits from such corrupt persons; for example, bank loan defaulter Sitaram Prasai was never arrested by Police, instead he was protected by police and politicians. Then, even if police force arrests and files corruption charges against such corrupt LDO, the judges are so corrupt that they won't do any thing against such corrupt LDO and this is the fact in Nepal.

Then, you guys talk about law and order situation and strong judiciary system and honesty in them in Nepal? When will that happen? When will corrupts like Khum Bahadur Khadka and Chirinjiwi Wagle get arrested by police and punished by court? Should we keep on being mute spectators by letting such corrupt LDO quitely do corruptions and ignoring the complaints of such a big public who have been suffering for a long time against such corrupt persons until we establish strong and honest judiciary systems?

I remember that many self-claimed democratic forces including NC and UML supporters put Kalomoso to many times on some oppressor of Janaandolan, such as Kamal Thapa and took them in the street in the past several times. Was not that inhuman to them? If Kamal Thapa or any other did really wrong, why not use police force and legal system to punish him? Why so-called democratic forces like NC and UML and their sister organizations in the government publicly come against the minister if they themselves have done inhuman activities to many other people in the past? Why are these parties making it a political issue?

Having said that, I personally disagree with the way the LDO was treated by Matrika Yadav; maybe he had to treat that way because the LDO could not be punished by legal system. I also disagree with many of the mistreatments of people by YCL in the past. But, sometimes you have to do something like that when law and order situations or systems are dysfuctional or  blind. I hope this kind of incidences will not have to be repeated again and again, and all such corrupt beaurocrats, polices, judges, and politicians will take this as an warning and will try to correct themselves in the days to come.

i can't disagree with you ctal.

but don't you think it will set a very bad example for a lot to follow. a mistake my NC or UML is not an excuse for others to commit same mistakes again.

my concern is how do we know that officer was guilty? how do we know he was not a victim? what should a  LDO do if mr. Yadav is found guilty of something? I understand your frustration but that's mine too and a lot of other's too.

A country like Pakistan where there was a dictator,people fought for independent judiciary and have almost turned the tables. why can't we? we don't need dictatorial attitude. I have a couple of simple questions to Matrika Yadav and his big chamchaas. First do answer them and then support his barbaric act.

1- How did Matrika confirm that the LDO was corrupt one? Did he himself try to bribe him? If yes, he was equally guilty person.

Note: All the Civil servants are not corrupts one, only very few are so.

2- He received complains from some indviduals, did he check the credit history of them? They might have vested interest on the LDO.

3- LDO is not under ministry of Forest and Soil Conservation, neither he was incharge of misntry of environment. Legally, he did not have right to even assaign a work to civil servant that belong to another misnistry, he was punishing the officer. He himself is voilating the law.

Why he did not report the case to concerned minister, Comred Dev Gurung? Is he laso a corruptted minister?

In Civil service system, under the each minitry, there are several  Departments. The political head of the ministry is a minister ( supposed to make policies), but institutional head is secretary of the ministry.

Each Dept  has Director general , as a head of organization. There are 5 different regional DirectorS and in each district will have class II  OFFICER as head of local office.

Did Sanky Minsiter obtained reports from appropriate  channels?

Perhaps he does not know all the black and white fact sheets. He knows only the language of jungle and  language of Mao, supress the opposition and rule the poor people.

Prabhat, well I have similar worries that you have ... I don't either want to see this incidence as an precedent as I have mentioned in my earlier posting and hope that it will not be repeated any more, at least to the really honest civil servants.

Now, we know that each community forest is run by local community, by default. Then, some mining factory is run by some person in that community forest against local people's will or permission and it is producing pollution and local people are suffering. Yhey have complained to the ministry and other government bodies in the past about it several times and it was not heard yet. 

Then, it's all about logic, not the seen or proved fact because no one including Chirinjibi Wagle takes bribes openly so we never observe the truth. If the LDO rejects the minister's request to help stop the factory from running there, then he must be protecting the factory owner; of course, with some benifits in return. So, maybe he is not, but logically he is corrupt person in many people's eyes.

I am sorry guys, but I am not saying that Matrika Yadav did absolutely right thing and that there was no alternative ways to deal wiht this issue. I agree that the best way to punish anyone, let it be Matrika Yadav or any other minister or that LDO if there are corrupts is by using judiciary systems.

However, my heart, and not my mind, was speaking in my earlier postings about this case. I have seen or heard many corrupt people at large, either they were not taken to the courts or the courts gave the clean chits to them without rigid proofs. In this case, I believe that, although I may be wrong, the LDO is a corrupt person and he got at least some sort of punishment; then my heart says - "khuchim, good job Matrika" even though my mind disagrees with the way LDO was treated.

I can't believe all you  people who are saying that his "intention" was  right. Does anyone know what  his intentions were??? You think his "intentions" were to punish the corrupt one, but how do you know that his intention was not to showcase  the power of a of a low-life individual who does not even have a bit of self-respect. Any person with self-respect would treat the other  person the same way  you'd want to be treated yourself.

Even if the person had committed a crime, shouldn't he be handled by the proper authority? If a minister of a country does not have any faith in the rule of law, then what can you expect from the ordinary people? If the system is not working, you,  MR YADAV,  have the responsibility to make it work. If you so much fantasize punishing the corrupt ones, why don't you join  the police force? Or become a lawyer? Oh..didn't realize you don't have the brain to become a lawyer!!

for this case i support mr.yadav. coz there are a lots of corrupted civil servant, now they think before doing and taking some thing like which can makes ordainary people in risk and difficulties.
   mr yadav think that we all have a power and we all are civilian so we need to change by ourself , from him we need to know that if some civil servent try to give us any unnessery problems just take him and lock him in the toilet even  to mr yadav also. so cheer up people we get a new idea to control the corruption.

मन्त्री यादब कै शब्दमा भन्नु पर्दा मन्त्री एउटा गरिमामय पद हो। यस्तो गारिममय पदमा बस्ने मानीसले आबेश आएर बच्चाको व्यबहार गर्न नहुने थियो। गल्ती गर्नेलाई नियम अनुसार दन्डित गर्नु पर्छ,दन्डित गर्ने नियम नभए राम्रो पारीपाटीहरु बसल्नु पर्छ। हङामा मच्चाएर देशमा कुनै परिवर्तन आउँदैन, आए पनि दिगो परिवर्तन हुँदैन भन्ने कुरो था'हुनु पर्‍यो....

There is not doubt that there are a lot of corrupt civil servants in Nepal and that they should be penalized, but, in no way what Yadav did was right. He is trying to run his old Kangaroo court by taking law into his own hands..... he does not have any right to punish anyone without due process of law and he should not take laws into his own hands. That right goes to the Police. If everyone starts taking law into their own hands in the name of improving law and order, then, there wil be no law and order.

The biggest culprits in Nepal are Yadav and his Maoists that are responsible for 15,000 + more Nepalese killings and now he is giving speeches on culprits....wow.

That's true, everyone should abide the law of the country. Whereas in our country, corrupt like Bam Dev Gautam and Govinda Raj Joshi were cleared by Supreme Court, so what do you expect from Mr. Yadav. Yes, he did a right job. Until and unless people take their own initiatve, Nepal will not head towards prosperity. Corrupt people should be punished after all.

Now that the issue of corruption has been raised let me be very clear as where I stand on this issue.

Nepal is one of those countries, where corruption is GLORIFIED, if not justified. People earn respect for how much money they have earned, how many storeys they have added to their house, and how rich they are. Noone bothers whether where the money came from. Even in some cases our relatives say, How stupid you are not have earned enough money as our neighbour Mr. X. This is what kids see and grow, including me. There is Akhtiyar Durupyog but the head of that commission is a corruption suspect. Again he may or may not be guilty.

On the other hand, the salary people earn in government jobs is so ridiculously low, that taking bribes becomes first a necessity to survive, then a habit and then part of life which is well accepted.

Corruption has both sides to it.

there must be just a handful of people who has never accepted a bribe or have never bribed others in one way or the other.

CORRUPTION RUNS FROM TOP TO BOTTOM, FROM A JOB OF AN INSIDER AS A PEON TO THE MINISTER TO GET A TRANSFER.

So what makes Matrika the sole bearer of the Nepali law to keep punishing others who may or mayn't be corrupt? What if he is corrupt? can we if we r LDO , can we punish him?

The point is let's have a system. It will be painfully slow but still lets not go backwards towards kangaroo court system but lets go forward as you are not guilty until proven.

Lets develop ethics in our future generation so that they know corruption is something not to be getting respect from. Let those fat cats in NC and UML or XML or HTML or any other party be punished no matter how powerful they are. Democracy takes time to grow but the way we are discussing here MAKES ME VERY OPTIMISTIC THAT WE CAN PROGRESS VERY QUICKLY.

Again, it will be painfully slow but one step ahead in a positive direction is always better than 1000 steps in negative direction.

What do you say guys. Correct me if I am wrong.
