i m student and my boyfren have got DV in nepal and he will be here shortly so what status will be of mine if i marry him like green card or same student do any one know about it

Dhide, As my knowledge, if you marry a person with GC, you will get two years conditional GC, which is same as the GC in terms of privileges, but you have to file a petition to remove that conditional status after two years of marriage.

thanks for info and i hope to get more well we are not married yet and we are planning to marry when he will be here. he had applied as single now when he will be here we are planning to marry then how long should i hve to wait to get conditional green card after the marriage ??

where should we need to file petition and how long it take to process and how much dose it cost can you provide me detail information plz

dhide, it sounds as if u are marrying for GC only. Why do you have to worry how long it takes when you know u will get one.

Hi dhide,

If he has applied as single now and when he comes here and you guys get married you'll have to wait until he becomes a US Citizen before you can get ur green card which may be 5 years or more and in the mean time u'll have to maintain ur status. But if he files as married and u guys get married in Nepal then you'll get ur green card when he gets his.

You only get the 2 year conditional GC if you marry a US Citizen not a GC holder.

dhide,

whatever TRUE said are true, but I suggest you not to take risk going KTM, though it may take 5 yrs for ur green card to get processed, I think you will get work permit and travel documents way earlier than actual GC, which will be very helpful too. something is always better than nothing.no need to worry cheers . ;-))

So ur best bet would be graduate and find a company to sponsor u a H1 till you get ur GC.

True, can you elaborate it little more? One can apply for GC only after 4 years of getting married? Does the original permanent resident need to be citizen by that time of s/he can still be a permanent resident for his/her spouse to qualify that?

True is correct.
You have two options:
1. get married before your boy friend applies for visa and let your husband apply for visa, you included as his wife/dependent on the visa application. That will be the fastest and easiest way to get the visa. (which i think is too late now as he already has applied for visa)

or

2. Get married when he comes here. Getting a green card by marrying a green card holder is a long process these days. Waiting period is at least 5 years. I would not be surprised if it takes 6 years by the time you get your card. Your imigration catagory will be family sponsored preference 2A, which has cut-off date at this time as 22 March 2002. That means, those people who applied for GC before 22 march 2002 by marrying another GC holder are getting GC now! So there is a wait of 5 years! But the best part is you can live together in the US as a husband and a wife, unlike those unforunate green card holder Nepalese who go to Nepal to get married and leave their wives behind for the next 5 to 6 years!

I would suggest you to visit the new and improved website of USCIS @ www.USCIS.gov and do some research. I am sure you will find your answer in no time.

(hint: They have new visa calagory for Spouse of GC holders)

As far as I know, If He got DV visa then ask your BF to send a letter saying that his status has been change, he got married..Actually, you guys need marrige certificate.If he send letter to KCC then you guys both can have GC from nepal but you have to go Nepal for the interview.But if he comes here in GC status then it will be same process, it may take 5 yrs to get green card and you have to maintain your status.

Once you get married you can file for PR right away.Its take like 4-5 years to get a green card.But as far i know once its get approved u don't need to maintain your status (takes1-2 years to get approved).
