Hi, I been recently approved for h-1b and havent been to Nepal for 8+ years ever since I came. I am hesitant to go and take risk of they denying my visa because my folks have GC and thus I am scared of getting denied because they may say since my parents have GC and thus I have no intention of coming back to Nepal.

I am employed Full time (not through consultancy) on IT field. Does anyone have a similar situation like mine? Advice please.

I haven’t heard of any experience with the cases involving your situation, you might want to search through other immigration forum sites. But I can offer a comparison. I used to have H1B and had applied for GC. I got a visa stamp when I was in Nepal and they could clearly see that I had applied for a GC, that means I have every intention of not returning back. I think I should have had a bigger concern than yours since it was me directly involved, at least in your case it’s your folks. The interviewer didn’t ask me any question other than how the weather is up there now-a-days and stuff like that.
I wouldn’t be too worried, but just to make sure do some searches.

 thanks stiffer, yeah i have not heard any cases similar to mine. I will consult with my attorney too.

Usually the embassy officer at KTM are easy and cool with H1b holder ... I got mine easily ... they were chilll... suggested me to get married. But in your case, since you have not visited 8+ years, they might try to give you some trouble. Also, I have heard stories/rumors that people with their parents having GC gets denied at point of entry ... i'm not sure how true is this. consult a good Lawyer, maybe have the lawyer write 2 letters - one to US consulate and other to the POE officer ...
