Hello Sajha Friends,

I received RFE (Request for Evidence) from USCIS regarding lack of Birth Certificate with the I-485 application though I supplied my school certificate showing DOB in AD calendar. I just got myself a certification letter from the Embassy of Nepal stating my DOB, place of birth, and names of both parents based on Passport and Citizenship and also that many parts of Nepal still do not record DOB upon delivery. By the way the Embassy staff were very eager to help and would like to thank them again.

My question: Did any of you use the DOB certification letter from the Embassy and did you have to supply any other secondary evidence to accompany the certification letter that effectively took care of the RFE and successfully got the I-485 approved?

I would be very grateful to know about your own experience and suggestions based on your experience.

i am not sure if the letter from embassy will satisfy uscis's request.  you need to get a letter from your wada office from the town you live in back home.  i think it's called "panjikadhikari ko karyalaya" or something (i am sure i messed up the spelling on that one but i am sure someone back home will know aobut it).  they will have a standard template for providing birth certifications and it will be in nepali which will have the government stamp on it.  it needs to be translated into english and notarized.  you need to send a copy of both the original and translated copy to the uscis which will satisfy uscis's request.

just make sure that it has both your parents name as well as the place of birth.  usually they only put the fathers name on these certifications. hope this helps.

Why do not you go to your municipality or VDC and get a letter, they will write a letter that you were born to Mr.... and Mrs..... and on ............ AD (BS) and place of birth. Have them write in English for easiness.


That will suffice. In addition to submitting school leaving certificate's DOB, I submitted a letter from my VDC stating my place of birth, date of birth and my parents' name (both mother and father), USCIS did not even ask anything, no RFE issued for me.


You can take your own wording and have the municipality or VDC write a letter for you. The letter was written like this by VDC on its letter pad as follows:


To whom it may concern:


The BOD register maintained at this VDC indicates that Mr...... was born to Mr ...... and Mrs ......... on ........... (AD) BS at .........

If you live in Nagarpalika, they must have english letter head, just get a letter in english stating that your date of birth along with what ever they wants to add extra ( must be in English date ), other wise you need to translate it.


No need to translate and waste of time and money if the letter head is in english and subject is in english.

One of my friend had the same problem. He got the letter from our embassy but that was denied too. USCIS was asking birth certificate with parents name. He submitted both,from VDC and translated one and got interview date within a month. 


I would advice you to translate it from the babarmahal even if you get the english version of DOB from your VDC/municipality to avoid any dealy.

I have a similar situation.
Is it necessary to have the birth certificate from the district you were born ? or you can make it from the capital KTM.

You will need to get a birth certificate from the place where you were born. I do not think, you will get one from KTM, they will not usually issue one to you. However, you can get around in Nepal in things if you know people.


Best bet is to get from your own place. No translation is necessary if it is already in English. What are you talking about dude? Translate English in English. Make sure you have your dad's and mom's name, DOB and POB. Get it done in English. Ask for the letter pad before hand and get it printed in English from a computer institute or on your own and have them sign. It is easy. People in VDC and municipality usually helpful in doing this.


My above advice is based on my own experience - what I did and successfully went through, it is not based on FRIEND's or something.

What you actually need is


1. Certificate of Non Availibility (this states that no such records exist, it is issued by your wada karyala)


2. Birth Certificate (this states your date of birth with your parents name and that it is being issued because there is no such records and has been verified with your other essential documents like passport, school certificate or nagarikta; this is also issued by the same wada karyala)


3. Finally you need an Affidavit of Birth Date (this is done in plane paper where your parents state your actual date of birth and that you are their son and all other essential details, along with your parents affidavit also have one made by your uncle and auntie. have these documents notorized. Then you are good.


Finally such samples are available on immigration voice  particularly trackitt.com.
